The businesses, all owned by Roger and Lisa Hawk, are based at 1001 Laurel Tree Court in Troy. Fifth Third Bank holds a judgment lien valued at $6.1 million against Hawk Construction Inc., a lien that Hawk Construction claims is contingent, unliquidated and disputed. Unity National Bank, meanwhile, holds a $5 million unsecured claim against Tipp Properties LLC and Troy Apartments LLC, according to the bankruptcy filings. Chapter 11 filings, the most common form of bankruptcy, free a company from the threat of creditors lawsuits while it reorganizes its finances. The debtors reorganization plan must be accepted by a majority of its creditors. Unless the court rules otherwise, the debtor remains in control of the business and its assets.
