HCG Providers Company won't return calls or emails. Owe me over $4,000 in reserves Pompano Beach, Florida
We run a reputable weight loss supplement business. When the FDA made announcements concerning our product, we had to find a new Merchant Account and ended up with Merchant Worthy. They kept 10% of our funds (or says the bank does, but they are the bank), for 6 months and then pay out. We had great service for the first 10 months of doing business and they started paying us our reserve at 7 months. Two months later, our reserves stopped coming. They said there was a problem with the 'bank'. I emailed them and would wait 2-4 weeks for a response. I left them voicemails and no return calls. I found another merchant among many that gave me great rates. I moved my service. I started calling and emailing again around month 6 of not getting my reserves. They said that if I stopped doing business with them that they bank will hold my reserves (10% of sales) for an additional 270 days and I wouldn't see my funds until October of 2013 ($4102). Nothing was ever mentioned - ever, about this in any contract I signed or verbal discussions. I asked why I was still being drafted $20 a month for their services if my account is closed. They stopped the drafts but have yet to reimburse me for the months that they drafted me. I have $839 in reserves that were withheld from me before I canceled my service and another $3263 in reserves that I now have to wait for until October - which is 16 months past my first month of my reserves being held that I have not paid for (~480 days). Is this legal? I feel jerked around by these people and bullied. When I called and finally was able to speak to Mace, he left me a voicemail stating that "I don't know why you thought you would get your reserves before 270 days?" I have tried to be kind and patient with these people but I have had enough and I want to make sure that other businesses don't get taken advantage.
