First, you did not reserve a Malibu. Hertz doesn't make reservations for a specific model, but for a specific car class. You reserved an intermediate class car, such as a Chevy Malibu, Ford Fusion or similar sized car. Second, sometimes the car class you reserved is not available - think about the person who had a reservation for that minivan after you did. If we are unable to give you the size car you reserved, Hertz policy is to give you a free upgrade into a larger class car. Apparently, Hertz did that, plus discounted the rate. Finally, there is something wrong with your story: "first then the tires blew out in the back cause us to crash". Both rear tires just blew out?? The odds of a single tire having a flaw causing a blow out are pretty minimal. The odds of both rear tires blowing out simultaneously are astronomical -- unless you ran over something! Also, I work for a large Hertz location, and we usually have at least 1 or 2 cars at any given moment on a legal hold. If we get a wrecked car where there was significant bodily injury or a death, the car is automatically placed on legal hold and remains there until Hertz's attorneys and the driver/renter or their attorney agree to release it. If the car was released and repaired, it was with your attorney's approval. It sounds like your attorney has tried to tell you that a one car accident is the fault of the driver. You hit something in the road, you lost control and you flipped the vehicle and crashed into the trees. I am truly sorry that you and your children were injured in a car accident. Stop trying to blame someone else. No one owes you a big insurance settlement. Get on with your life and your children's lives.

yes i did get a lawyer but for some crazy reason they claim the car was removed from the sight so they had no way to have a investigator go down there and check everything out, so then the lawyer told me i did not have a case against hertz but my children had a case against me, i was upset about the whole thing the lawyer tried to prove his hardest that i was at fault but my police report, and the witnesses stated other wise i'm not giving up on this not at all

Is he or she an idiot? You don't give up just because Hertz won't answer questions. File a lawsuit, subpoena records, everyone at Hertz whoever touched the car, get all of their maintenance records, how many miles were on the van, what they did with the van after the accident. They HAVE to answer these questions and produce the records if they are under subpena. If you don't have an attorney, GET ONE IMMEDIATELY. If you can, do an internet search on Hertz -- they have been involved in a lot of lawsuits for renting out defective cars. (You might have to go state by state, so start with lawsuits in your own state first). Subpoena everyone who looked at the van after the accident, too. Don't let Hertz get away with this. Get an attorney right away. Also, in some states, there is the concept of "spoliation of evidence", and a company can be fined for doing it. Good luck!

Have you sent a letter to the editor? If you leave out the name of the company they might print it. This story is so sad, why CEO's are letting companies harm the customers is beyond me to figure out. Oh dear, well mom, our prayers & hearts go out to you. They probably will deafen your attorneys with silence and noncooperative acts if Hertz is marching to the same music of many companies these days. All you will have to cling to is the realization that the cover ups usually are discovered and the same top brass that refused your cries for help will get in trouble for not helping you. Small comfort but in todays world of high dollar, nasty lawsuits that reduce families to rubble, there is not much comfort. Sorry to hear of your tragedy. Good luck. Maybe they will call you someday and do the right thing if they did rent you a bumb vehicle.
