Home Depot (HD) sold me double hung Simonton windows for my bedroom and assured they met egress codes, saying they'd get the permits. On the contract I made the sales rep write not to remove the original wood molding on the exterior because otherwise they would wrap the whole frame.  Well, the installer came and ripped up the wood in each window. I stopped the job. A manager came and said they'd fix it. We set up an appt. for that. Instead of fix, more managers came and tried to convince me that fixing it would be too costly and almost impossible and that they don't have people to do that.

I got estimates from other window installers to fix the wood and notified HD of them.

They offered to pay for the repair up to a certain amount so I hired a company to prepare the wood, but then I realized that the job might cost more because it was just an estimate that I received from the 3rd party, so I requested more up front from HD, or just to send them the bill afterwards.

HD came back with "ok, we have people. we're sending someone tomorrow'. I already had hired another company to do it, so I owe the other company the money for the wood.

Also, I was lied to. The manager said he was here with the the wood guy during the week and he's confident that the wood guy can do the work. I was home that week and he never came. Also when the wood guy finally arrived, he had obvioulsy only seen pictures and never been on site. This guy came with substandard wood and molding, one that's used for interiors. My architect was here to verify this.

Now they're offering me back the original amount, but now there's another problem: it seems they haven't gone through the city for the permit, and I got a stop work order from the city.

I'm sending a letter to corporate tomorrow. Frankly, I don't want to pay for the labor of their job after all this rigamarol and stress.  Do I have to sue them, or wait for them to sue me for payment?
