In 1998 we took out a loan with Homeside Lending it is a 15 yr loan and we have been faithfully paying on it for 5 yrs.Last year(2002) we ran across some tough times and had to file bankruptcy which believe me this was a hard choice to make but we had exhausted all other options.In march of 2002 the bankruptcy went thru but because we were in such good credit standing with Homeside they agreed to let us continue paying the mortgage and keep our home.

We were never late on a payment and were in good standings with them.In April they contacted us and said we can refinance your loan and save you some money and we thought this was great so we proceded with all the paper work.We followed their instructions faxed them everything they wanted in record time mind you.They called and said we are ready to go forward.

We were told by the Loan Agent at the time not to worry about making May's payment as the loan and all would be final before it was due. We agreed and proceeded to catch up on a few other bills that had got backed up .The agent even said if we do go over a few days not to worry they could tack on the payment to the loan.In the process the agent we had been dealing with either got fired or quit and we were not notified. Time was getting slim and we were getting very concerned so I contacted them and they had told me a new agent had taken over our loan and had yet reviewed them and I said well the loan was suppose to be ready to close and I was told well its not and the agent will contact me . I hung up and was very upset explained it all to my husband and I called back the next day.

I was then told we cannot refinance because you are behind a months payment. When I explained to the agent what I was told she told me I was misled and it was our fault, we shouldnt have listened to the last agent.Needless to say we didnt have the money to make May's payment and now June's was due.We tried to catch up but we couldnt. My husband is disabled and on Social Security and I am working but not making alot.We have an 11 yr old daughter and we have other bills and food that we needed. I contacted Homeside and tried explaining to them the problem and that we felt it was their error that got us this way and asked if we could make arrangements to get caught up.

I was then told no you need to pay 1,819.00 and that will solve the problem. I said i dont have that I have other bills and food I need to buy and I was told which is more important a roof over your head or food. I was very upset over this.

Then I was also told that we owed them a driveby fee of 21.50 because they had sent someone by to make sure the premises had not been vacated. I said get real I am making 900.00 payments to you a month and you think I have vacated?? I mean how many people make those kinds of payments and vacate their home.No matter how hard we tried with Homeside it was never enough. We have never been treated this way in our lives.

My husband bought his first house in July of 1962. Was never a day late and was paid off in full house was located in St.Louis ,Mo. He then bought a house in Fenton , MO in March of 1974 paid that house off never a day late. Bought the house we are currently living in March of 1978 was never late on a payment until Homeside Lending screwed us.
