niagara falls,#2REBUTTAL Owner of company
Tue, December 27, 2011
As I have said in other rebuttals in this case, Lim presented himself as an attorney in England prior to comming to Canada, and Chemist in Canada for the past 30 odd years. However when a gentleman that came into the plant recognized him as a gas station attendant, he wanted to get out of the business real quick. Lim purchased 50% of the assets of U-Pac Products Inc. (Exhibit 1) but he now goes on to make a number of false claims. He says I was his salesman and didn't sell his product. (Exhibit 2) In his Plaintiffs claim #1454/10 he says his $25,000.00 was an investment (Exhibit 3) In his statement to Judith Callender he claimed his investment was a refundable deposit. and at the bottom of the paragraph he claims the monies should have gone into his company account that he opened (3 weeks later) claiming he was the 51% shareholder. (Exhibit 8) He also made a deal with Judith Callender to become a witness in a car wash dispute. (Exhibit 5) He further claims in his statement to Callender that he produced almost 8 skids of product (Exhibit 6) When he left we found 1 1/2 skids (235 cases) which we scrapped (Exhibit 7) Where did the other 6 1/2 skids of product go? When I happened to walk into the plant one day I found Lim and his son Gerald loading numerous cases of product into their van. When I questioned Lim, he said he had people in Toronto that were buying it, however I never saw any monies go into the company account. Lim absconded with over $27,000.00 in company inventory and to this day the company has never received a dime.
As far as his vicious claims against my wife he is totally out of line. Her conversation with Lim probably amount to Hello and Goodbye. She is not an owner of Hydro Shine or any other business. She only agreed to to be a partner in U-Pac Products Inc. because she though Lim was a successful businessman. She never in her wildest dreams ever though he was a gas station attendant with no Chemical plant experience.
