I initially emailed an agreement to utilize Iroquois Merchant Services (IMS) for credit card processing to Sara Lopez on April 19, 2015.  I asked her not to start the service until we were ready to go.  We were having a new website built and wanted this to be the last change we did.  She told me not to worry since a credit check had not been performed and to let her know when we were ready.  She obviously put the application in immediately without telling me.

 

The fees started coming out of our account in June 2015.  I can supply our bank statements.

 

June - $40

July - $10

August - $54.93

September - $55.88

October - $55.88

November - $65.93

December - $65.93

 

TOTAL - $348.55

 

After we figured out these charges were not from our current merchant service but from IMS, I contacted Alastair Miller.  He had me sign a document that I emailed him August 20 to deactivate the account.  Since that time IMS has continued to take money out of our account for four months (September - December). 

 

Alastair emailed me to let me know that Elavon (a supplier of IMS) had put $159.90 back in our account this month.  When I did the math ($348.55 - $159.90), I came up with a balance of $188.65 owed to us.

 

Based on a conversation I had with Dan McGugin, CEO, he stated that the termination of the contract was in August when I emailed Alastair the decative document.  Given that ($243.62 Sept. - Dec. fees - $159.90), that leaves a balance of $83.72 that should be put back into our account since IMS was not authorized to take any money from our account as of August 20.  I also can supply the deactive document.

 

I spoke with William Panitz at Elavon (IMS credit card providor) after my discussion with Mr. McGugin.  He looked at our account and stated that the decative form that I sent Alastair on August 20, was not sent to them until December 15, 2015.  Not sure what happened there, but I did what I was supposed to do to deactive.

 

It's not about a given monetary sum.  It's the fact that we are having funds withdrawn from our account by an unauthorized party.

 

Mr. McGugin admitted that they made a mistake.  I'm taking the first four months out of the equation and am ONLY focusing on what monies were taken out of our account (Sept. - Dec.) after I sent the deactive document on August 20.

 

After I emailed these facts and our statements to Mr. McGugin, I received an email back stating:

 

"Per our conversation yesterday, we recognize that you are owed for fees deducted between September and Dec. I do not have the exact amounts in front of me. This total is roughly $187. You have been reimbursed roughly $160. Therefore, you are owed roughly $27, which has been requested to be sent."

 

"do not have exact amounts", "roughly".  This coming from a man who handles financial matters for clients?!

 

I replied back that his math was inaccurate and unacceptable.

Elavon has reinstated all of the money taken out of our account as of January 27, 2016.
