In 2004 my husband and I went through a refinancing of our home. It took four months before the signing happened and we ended up having to sign the documents in Sacramento, California because we were on a scheduled vacation. In 2005 my husband and I were forced into bankruptcy. When the current mortgage company filed their claim with the bankruptcy court, part of the documentation that was provided was a copy of our mortgage, of which we had never received a copy of. While reading through the document I found the signature page and realized that these were not our signatures. I then turned the page to see, in the same handwriting, a signature of notary, James M. Cohen, attesting that we had sat before him on April 4, 2004 and signed these documents.
Since then we have sued Mr. Cohen in Federal Court and he has been found culpable for his crime.
