James, Stay off the phone! NEVER speak to ANY third party debt collector. NEVER!! Demand everything in writing! There is no reason to ever speak to any third party debt collector. It will NEVER do anything positive for you, and will USUALLY make things worse for you. At this point, send a CEASE COMMUNICATIONS request by certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records. This procedure is very important to follow exactly. DO NOT sign the letter, just print ,and DO DOT give them ANY personal, employment, or banking info. ONLY provide your name, mailing address and the phone#'s they are calling. DEMAND that as per the provisions of the FDCPA, they are to cease all communications immediately, or face the consequences under the law. That's it. Done. Now, when they violate your LEGAL request, you can have them paying you!

Hi James. I feel your pain with Alliance Management. My situation was simliar. I took a cash loan at Check N Go, and another cash advance online (which I will never ever ever do again). After doing the online cash advance, suddenly several other deposits from other advance places started bouncing into my account along with several monthly withdrawls. I couldn't track down phone numbers for the mysterious advances and tried several times. I tracked everything and eventually closed the account at my bank and filed an identity theft charge. It wasn't technically identity theft, but I didn't want my credit to suffer for charges that were not mine. Anyway. When I closed my account I was approximately $1500 negative due to the massive deductions out of my account (which I got back later) and my Check N. Go account went deliquent. Alliance Asset Management started calling me at my office asking for money for this debt. In your situation, they are trying to close out their debt by the end of the year. I used to be a credit and collection manager and stepped out of that nasty business. The collectors are paid (at most places) based on what they collect and have quotas to meet. You may notice heavier calls towards the end of the month, and specifically towards the end of the year. When they called me the first time I explained the id theft thing and asked that they send me a copy of the contract and the check so that I could verify the validity of the debt. There were so many advance debts the names ran together and I couldn't keep them straight. The collector told me that he was going to mark me as "refusal to pay" and hung up on me. The next day someone called again. I told them that I needed the proof as previously requested, etc. It took 4 calls to my work telling them that I wouldn't pay without proof before they mailed me what I asked for. I called them back and offered payment arrangements on my terms. They weren't accepting of the payments. I simply said "You can take $XX, or nothing because that's what I have". They refused and threatened legal action. I told them to go for it, and I'll provide my recorded proof to the judge that I made a good faith attempt to pay the debt and was refused. About a week later the messages started from Dan Dwyer. They are recorded messages, he's not leaving them personally. They were left about 10:00 am every day for 3 months and said that he had to make an important decision on my debt TODAY or further action would be taken. I made the decision to ignore the messages until they called me personally. After the 6th or 7th message saying that he was making a decision TODAY, I started thinking "yeah, sure you are". Then in November AAM sold the account to another collection company. The lady called and and was very respectful and sweet. The debt was a total of $500 plus all fees. I told her that I could only afford to pay her $225 total for everything. She got approval for it within minutes, I made the payment over the phone, and I just checked my credit a couple weeks ago and it's been removed from my report as paid in full (not settlement, paid in full) Be firm with these jerks, don't let them push you around. Just like telemarketers, they are salespeople out to make a buck. If you don't buy into their threats of legal action, they dont get a paycheck. Tell them what YOU will pay and when YOU will pay it. If they don't like that, they don't have to take anything. Document everything so that you have proof that you made an effort. Good luck!
