Mr. Romano with greed and negligence in his eyes has set out to essentially steal $80,000 in a commercial real estate transaction. Sounds petty that a guy would risk his lively hood for such a small dollar amount but that's who you will be dealing with if you proceed with his representation. The story in short is; there was and still is a mortgage contingency clause in purchase contract that should have clearly protected the buyer when the appraised value came in 45K short. This is an easy fixed 10/10 times with either a renegotiation of contract or a return of EM deposit. Instead, Mr. Romano failed to file the proper paperwork once the appraised value came in short and decided to "white out" documents and back date items. I have proof and will make these claims in court with my clients newly retained attorney. He then proceeded to bully the borrowers into accepting a higher offer on a commercial property or told them they risked loosing EM deposit. Both illegal and unethical from an attorney in NYS.
