I first started using Hushed, an iPhone app developed by Justin Shimoon of AffinityClick, on December 10th, 2017. I purchased the Unlimited Monthly Number plan which was to be active until January 10th, 2018. On December 28th, 2017, the plan I purchased had seemingly disappeared. I notified Hushed of this and received a response from an individual by the name of Jason from their customer service team. Jason stated the following: "We believe the transaction should be refunded by iTunes immediately. You can request a refund from iTunes." As per Jason's request, I contacted iTunes and requested a refund but was told that it was not eligible for a refund. I advised Jason of this and he then responded with the following: "Unfortunately Itunes does not allow for developers to issue refunds directly as per their policies.” This second message from Jason was a complete contrast from his first message. Why did Jason originally advise me to request a refund when he was already aware that iTunes could not offer me a refund to begin with? He essentially had me go through all of that trouble for nothing.

As I was getting nothing but the run-around from this company with no resolution, I obtained representation and a letter was sent to Hushed CEO Justin Shimoon asking that a refund be placed back onto my credit card for the failure of service. Mr. Shimoon responded to my representative stating that he would be willing to offer me 12 months of free Hushed service equal to $60. As I had already found a different application to use, I was no longer interested in using Hushed, and my representative advised Mr. Shimoon of such. Mr. Shimoon then responded with another offer of 2 years of Hushed service equal to $120, despite the fact that my representative had already informed him I was no longer interested in using Hushed.

It seems that Mr. Shimoon is doing everything in his power to avoid providing me the refund that his staff initially stated/agreed that I was entitled to, and is instead doing everything to keep their business active.

If I do not receive a refund for the failure of service, I intend on filing a Civil claim against Mr. Shimoon, and I also intend on reporting him to authorities for Fraud.
