When you purchase a vehicle from a Malone dealership, they promise you and claim that they can finance anyone that has had bad credit and even including bankruptcy is no problem.

They will be happy to fill out deals and take your deposit and then as soon as you drive away it all starts.

I called the Toyota dealership in Sandy Utah to ask for their credit manager and explaining my current credit situation and asked if they could accommodate me. The credit manager took my information and called me back explaining that he was able to get me approved for up to $35,000.00 with an outside financier. For over 3 weeks, the dealership played the phone tag game and the I need more information games with additional forms. Then a phone call from the financier to verify what the dealership did, along with a request for additional information. Another week went by and I asked the dealership if this was final or not. Several days later and after I had put several thousands miles on what I thought was my car, the dealer called and said that they could not obtain financing. Per the dealer's request, the vehicle was returned. The dealer never even told me that the dealership has internal financing that could have assumed the loan. A deposit for over $700.00 was given to the dealer; which they cashed the very next day after they signed the deal. They refused to refund the deposit as they claim they can use it to offset the mileage on the vehicle. My attorney has written to them and sent 3 copies of a letter requesting the refund and explanation to the purchase and deposit; which they have flat out refused to do.

Your "legal team" will most likely tell you that this is standard operating procedure at many dealerships these days. You signed a piece of paper that basically said you were taking the car on the assumption that it could be financed at these agreed upon prices and if it could not be done at that rate then you would either return the car or pay a higher rate to get financing. And let me guess - three to five days later they called and said they couldn't do the deal at the price they said and it was going to cost more, or the rate was going up, or there would be more or larger payments. When you balked, they told you to bring the car back or they could charge you with theft. Sadly, this happens more and more these days. They knew the moment you left what financing deal you qualified for, they are banking on you falling in love with the car and agreeing to the higher rate. The best defense is to never sign these "conditional finacing" documents and if necessary, do your financing somewhere else.
