We used to be a photographer for kids.com so I have first hand knowledge about why you shouldn't blame the photographers for the kids.com issues. The photographers were not paid any additional fee by kids.com. The only fee we earned was from the kids.com (the $20 you paid for the sitting). We photographed the children, and then sent the image to kids.com to be posted on their website. We did it because we hoped that the client would purchase additional prints or come back in for a full session/order (or refer us to friends). We had so many people who came in thinking it was a way to earn money for their children's college fund. Many of the children were poorly behaved, didn't listen to the photographer, or wouldn't sit still so we knew there could be issues when they went to a "real" photo session for a commercial. I don't know how you can get your money back, because there was no guarantee that your child would be a star/make money. The key is to go after kids.com, as that's who you signed the contract with, not the photographer.
