My husband passed away on March 4th 2015. He was an owner operator for LAD trucking in 2011 and then for the last year and a half of his life. Both times James worked for LAD, they had mandatory payroll deductions titled "escrow funds" in the amount of $3,000 each time - to be used in the event a driver damaged the trailers they hauled. If the trailers were not damaged, the employees were to get that money back.
The day before James passed away, LADs owner Lonnie Deason, called us in the emergency room and informed us that eventhough there was no damages to the trailer, he would be confiscating his $3,000 in escrow to cover Workmans Compensation Premiums.
We later found out that LAD Trucking had been misclassifying their drivers as "owner operators" to get out of paying workmans comp premiums. They were also setting up these bogus escrow accounts and then creating ridiculous reasons for keeping their money- in our case - James's first $3,000 was kept by the owner because he was inconvenienced on his day off and in lieu of reporting James to the DOT for a violation... he was going to keep the $3,000 for his inconvenience. So James was BLACKMAILED - told by the owner his career would be over if he reoported him.
An insurance audit discovered their workmans comp scheme and that is when LAD took James's second escrow fund. Leaving a widow and her child penniless and broke with no intent to even give a little bit back.
Now, LAD trucking is refusing to furnish our family with any Workmans Comp details so we can validate the policy and try to get any sort of compensation from that -- of course we know why- but they are refusing to give us any sort of accounting of the first $3,000 from 2011 and the second $3,000 , they have blocked us from all contact and will not respond to any messages.
