To whom it may concern:

I have been going thru this for over 2 years with Ladies Workout in Johnson City. I called the local owner in Feb.2002, she stated that all I had to do was to write a letter to her and stop payment from my checking account.I was told by her there would be no problem, 2 weeks later she contacts me at my job and says that she did not look at my contract.

She continues to tell me that I owe for 2 more years. I only went for 3 months, also when I signed up I told her that it would be hard for me to come.So after the year was up and I had paid this woman a deposit of $50.97 and also 27.09 a month for over a year without even going to the gym!!!

She has now turned my account over to not just one collection agency but now I am having to listen to the second one. I feel I have been lied to by this woman and that she WAS NOT honest with me.

I was also called at my work place by her and the collection agency. In april 2002 I contacted the first agency by letter.

I am worried about my credit thanks to this woman. I really don't know what to do now! I do not feel as if I owe them anything!

I paid for over a year without even using the gyms facility. I live 30 miles from the gym itself!!She is ripping people off! I have 2 more friends that wanted to get out also and they had a hard time with her also!

Even your guy Jesus knew that. Like I used to tell my rookies, " NEVER,EVER judge something by what it APPEARS to be outside!" BELIEVE NOTHING UNTIL YOU HAVE ASKED QUESTIONS, DONE A BACKGROUND CHECK AND DONE THOROUGH RESEARCH! DO NOT PUT YOUR NAME AND FINANCIAL INFORMATION ON THE INTERNET EITHER! I think Curves is a good idea ran by greedy people. My advice is don't trust a company that has to lock you in an agreement, on top of that dont enter into a contract with auto bill pay. In my experience Curves is unforgiving when a person falls on hard times, not only that they go back on their word, and refer to the "contract". And they have the nerve to say I'll pray for you after they lie to you about getting out of a contract, while taking your money!

If Miss Ronda signed a 3 year contract - then she has to pay $27.00 a month for Three (3) years, even if she only went to the club 3 times! It is so important to READ before you SIGN! You cannot just sign away, and then think you can stop your contract just because you decide not to work out anymore. You are bound to any contract that you sign. Unfortunatly, some people do not take them seriously. If you bought a car and your payments were $250/mo, and lets say you didnt want to drive that car anymore, does that mean you get to stop paying the $250/mo? Obviously no. Joining a gym is an investment in your health and its should be a life-long investment. Many people do not realize that and make claims like this one. Please be more intellegent in the future.

I was a manager of a LWE in Texas for 3 years. There is a 3rd party company called National Fitness who manages all of the accounts and account drafting for the Lady of America corp. They are the entity who is refusing to delete your account. When you sign the contract agreement it is a contract that National Fitness provides the LWE unit. I dealt with this issue more times than I can count. There were even instances where a contract was legitimatley canceled according to the contract rules and National Fitness reopening the account years later and charging the ex-member or sending their account information to the collections agency with an unreasonable balance. I am very sorry for your experience, no one should have to go through it. But the business owner is not the one to blame. Although it sounds as though she was not properly informed about how to handle the issue once it went to this point. You should have been given your member ID number, the gym ID number, and the toll free number to both Lady of America and National Fitness so they higher channels could help you resolve the problem. Rhonda, When you receive a letter from a second collection agency it generally means the first collection agency sent the debt back to the company. Because of your letter to them disputing the debt they don't want to waste time on it. You need to send a letter to the second company stating your dispute just like you did the first within 30 days of them contacting you in writing. See this web site for your rights when contacted by debt collection agencies, how to file complaints if they violate the law. http://www.ftc.gov/bcp/conline/pubs/credit/fdc.htm The key is to immediately dispute with them the debt and ask for proof of the debt. They are required to provide proof of the debt to you if you request that in writing. Many times they cannot, so they return the account to the company they got it from. They don't want to waste time on uncollectable accounts. The company then sends it to another agency. Good Luck.......

Call your bank and tell them to cancel any payment to these people. They have to do what you say. Tell the bank that these folks are fraudulently charging you for money you no longer owe. Call the police and tell them that you have been receiving harassing phone calls at work abd would like a police report filed. Call these sorry bastards back and tell them that you have talked to your bank and also had a police report filed. Tell them you need a street address where you can contact them in writing and so your lawyer will know were to contact them. (You don't really need a lawyer, just tell them that? I guarantee you that the harassment will stop. Tell your bank to contact the credit people and let them know what's going on. That way this will not affect your credit rating. If they call you at home, simpy tell them to take you to court. That's the last thing in the world they'll do. They'll see that you are not messing around and quit aggravating you. I've done this. It works.

CURVES IS A KING SIZE FRAUD ALSO! i joined being told that i had to join for 12 MONTHS. I only wanted a few months. TheY told me that i could pay up front or pay monthly through my bank account. Big mistake - they snuck in a clause allowing them 3 years access to my bank account. It was a cheap xerox of a contract so i didn't read the small print. After a year you guessed it they kept taking money. I asked them to stop. The bank stepped in and reversed their withdrawal - Deception, little equipment, untrained - often out of shape advisors. Bad experience all around. GO to the Y if you need a bit of exercise. tHANKS TO MY BANK LADY'S EXPERIENCE WITH MANY OF THE LOCAL 'EXERCISE RIPOFFS' I WAS HELPED TO FREEDOM FROM THIS SCAM.

You should have looked into Curves for Women. The Franchisees of LWE & LOA wouldn't have had all of these problems. And the consumers would not have came across these canceling problems. Curves cancels with no problem. We do not GO AFTER people. LWE does because they are hurting. The founder of LWE copied off of Curves and they are hurting now. No one can compare to Curves. This is why they have to act like such jerks. They are starving, and they have to rip off people in order to stay alive. Don't give up on working out. Find your local Curves for women... they will help you and I promise, they will treat you right. DO NOT EVER join Ladies workout express or Lady of America. If you go to the website for ladiesworkoutexpress, and you find the picture of the founder, he looks like a total scum bucket! He really resembles a used car saleman! Eww!
