Thank you for all your responses. We appreciate and look into every single complaint that we receive. Our reputation is very important to us and problems/situations like these are handled accordingly. In reviewing the history of this complaint, we have concluded to the following. 1. The 'NON CANCELABLE' lease that this merchant SIGNED is deemed valid. A legal piece of document disclosing these terms were signed and under the laws of the state of California, this is a legal binding contract. 2. The lease was signed through CIT Leasing/LFG. BankCard USA is a totally separate entity from CIT Leasing. The lease of the credit card terminal is done through CIT Leasing-not BankCard USA. All documents signed by the merchant indicating 'NON CANCELABLE' are through CIT Leasing. Please contact CIT Leasing in reference to all leasing questions. Their number is 800-747-1281. You keep mentioning the word contract. Do you actually know the definition of the word contract? CONTRACT - An agreement between two or more parties which creates obligations to do or not do do the spceific things that are the subject of that agreement. The operative word here is not to do. You see it is not me who defaulted on the contract. When Bankcard USA continually took money from my bank account that was not apart of the contract, that created what is called a BREACH OF CONTRACT. BREACH OF CONTRACT is a legal concept in which a binding agreement or bargained - for exhange is not honored by one or more of the parties to the contract by non performance or interferance with the other party's performance. Your like a cat covering up its crap! A contract is not one-sided. Even though I may have signed a contract with you does not mean that you can do whatever you want and I can't do anything. A contract involves two or more parties; a meeting of the minds. When you default on the contract, it's not my fault. I am in a position where I deal with contracts for hundreds of thousands or millions of dollars. It would be perposterous to go to closing and say " oh we changed our minds the house is for five hundred thousand not two hundred thousand". That would automaticaly create a breach of contract. The contract you loosly refer to is the same. You can't change things without the other parties permission, just because you have access to their bank account. I stand strong that Bankcard USA , Lease Finance Group , and other credit card merchants the are affliated with LFG are riping off hard working consumers like me. The power over a persons bank account is outstanding. Our only choice is to close our accounts and stop the bleeding. Everytime you turn around its another fraudulent amount being dedcuted directly from your bank account that's is not apart of the contract. Julie San Antonio, Texas

I do feel that Bankcard USA is a reputable company, I also understand that the company is vast. Which means that it is possible that you have someone working for you that is not honest and is misleading. My beef is not with your company but rather possibly with one under your employ. Your reputation is important and I understand this. You will probably be spared however, the person misrepresenting you will probably not be.

This is in response to the merchant's rebuttal dated August 14, 2007. BankCard USA replies to every complaint filed against us. Each merchant account gets issued a merchant number and our system tracks every memo, every call that gets posted about their account. There had been no indications that this merchant has ever filed a complaint against BankCard USA. I personally have not recieved any calls from this merchant. I would know, because it is my job to respond to every complaint, every rebuttal about BankCard USA. I have never received any phone calls or messages from this merchant. As previously stated in my first rebuttal, the lease that the merchant SIGNED is NON-CANCELLABLE. If the merchant felt like they were misrepresented then why didn't the merchant read the terms and conditions of the lease? It is the merchant's SOLE responsibility to read these terms. There were 2 sets of documents showing that the lease was NON-CANCELLABLE. Additionally, the lease is also verified over the phone to further reiterate that the lease is NON-CANCELLABLE. Also, please note that the "month to month" contract the merchant signed is for the merchant account, not the lease. The merchant has the right to close/cancel their merchant account with us. This month to month document is for BankCard USA-not CIT/LFG Leasing. Our decision remains-this lease is deemeed valid. Thank you.

Dear Sharon, Why am I not surprised to finally see a reply? Where is your reply to my letters and phone calls? If you are able to figure out who I am thru my complaint on this website, then you must have my file. Have you talked to your salesman Larry Robbins? He sold me a contract of lies and deceipt. Pretty much what everybody else is saying. The so called "non cancellable lease" is a joke. Do you honestly think that all of who are complaining are ignorant? You people are trained to sell by a tatic called "smoke and mirrors". Well, I am a real estate agent who is used to negotiating contracts. The contract I negotiated with Larry Robbins is NOT the contract we signed and agreed upon. He completely misrepresented the contract in every way. He laughed at me when I mentioned the month-to-month Merchant agreement addendum that he signed. You see, I would never enter into a contract without an option to get out. How stupid do you think I am? He told me and I quote "you're a business women, that addendum isn't worth the paper it's written on". If that's the case then neither is the so called "non cancellable lease". Not to metion the forged part that Lease Finance Group sent me. I am dumbfounded that a company would take liquid paper to a contract and alter the dates. Its so obvious and its on the contract they sent back to me after I sent you a certified letter along with the completly unused equipment. Once I found out I had been duked by Bankcard USA, I knew I had to get out. Bankcard USA started drafting fees from my bank account that were not EVEN CLOSE TO BEING apart of the contract. You have stolen money from me and you know it. It was only after LFG started drafting money from my account also, I knew I was screwed. Do you have any idea what it feels like to have people stealing out of your bank account? It's scary as hell. The only way out is, to close your bank account. Your company and its association with Lease Finance Group is a racket. How do you sleep at night knowing you work for a company who is stealing from their clients? I don't have the time to go into all the other details of this transaction, but know this; Bankcard USA has broken the law. Your affliation with Lease Finance Group is a racket. I am sorry you work for these people and I hope you find a job you can be proud of, but if you want to talk to me about this, well I am sure you have my number because you d**n sure gave it to LFG. They call me at least 8 times a day and are the most rude people I have ever talked to in my life. What a joke! This is not a threat, but this time you really have Messed With Texas. We are responding to a Ripoff Report posted above. In reviewing the merchant's comments and complaints, we are willing to help this merchant resolve their problem with BankCard USA and/or Lease Finance Group but need more information about their actual complaint. Please have the merchant respond to us in writing about their complaint to the following address/contact information: BankCard USA 5701 Lindero Canyon Rd Bldg 3-200 Westlake Village, Ca 91362 Attention: Complaint Department/Sharon Tan If merchant is contesting their lease, please have the merchant provide a detailed explantion of why they feel that they were ripped off and the reasons behind it. Our records only show that this merchant opened up a merchant account with BankCard USA and leased a terminal with Lease Finance Group (which is an affiliate of BankCard USA). The merchant opened up a merchant account on October of 2006 and closed (for the reason "did not need service" on May 14, 2007). There are no additonal indications that this merchant ever filed a complaint with us about their processing nor their lease. The merchant signed into a "non-cancelable lease"-(in which the word "cancellable" can be spelled either way-with 1 or 2 l's). Additionally, please note that Lease Finance Group's lease paperwork indicates that their lease is non-cancellable on 2 separate pieces of documents. These documents are to be signed by the merchant-in which this particular merchant did sign. Also, Lease Finance Group verifies all their leases over the phone. They want to make sure that all lessees know that they are getting into a non-cancellable lease.
