I called this company hoping to get a permante modification with my mortgage back in october of 2009. I spoke to a man name Luis Rodriguez @ 561-948-0337 ext 367 I was upfront with this man telling him my story that I am a mother of 4 kids and my husband walked out on us leaving me with all the bills. I told him that I was on a temp repayment plan with the mortgage. He told me that everything will be ok and that they can get me a permante modification on my loan. I agree and paid 2750 it seem like once they had my money I couldnt get a decent update. Christina lemaster the negotiator ph# 561-948-0353 first contact me in december of 2009 and this is what she email me:

Today, we called and spoke to your lender regarding your loan modification request.  The latest update on your account is mortgage co is reviewing for final modification.  The negotiator on your case needs some updated documents to complete the process.

 

  1. Updated pay stubs (1 month)

then she email me later on in december

Today, we called and spoke to your lender regarding your loan modification request.  Called lender spoke to DJ (ID: DJJ)...on 1/15 the underwriting dept is requesting the 2008 tax returns to be signed (pg. 2). He's not seeing the UTD pay stubs either. (I faxed on 12/29).  Please sign the tax returns (attached) and get the last month pay stubs. Fax to me at 888.777.8213.

 

I will be following up with the Home Retention department next week to confirm they are working on your account.

 

So I am thinking that everything is going great and that I would have my modification soon. NOT!!!!! fast foward to march and nothing so I email luis to see if he could help out and this is what was said via email

good morning I hope you are having a good day as for myself I am not. I have email and called Chrissy requesting an update and have not heard anything for 11 days? I am very upset because this modification has been dragging on for almost 5 months and I am ready to get this over with. I need to know what is going on when I check on my status on the website there is nothing and it has been like that from day one. I dont understand how you guys say you help people keep there homes when the customer cant seem to get a response. Please call or email I need to know soon whats going on. Thanks

 

Jen the process can take up to 6months + mine took 9.5 months. Your lender is holding this up. Please forward me the email Chrissy sent you!

Then in march I finally get a response from christina and this is what she said

 

Jennifer, your file was forwarded to my manager and then given to Perry in Underwriting.  I have let Perry know that you are looking to get some sort of update.  I do apologize in the lack of communication and I have also spoken with Perry about this matter this morning personally

 

well it turns out Perry never called nor email me anything turns out Perry quit his job and my case was in limbo. I email luis in april and in may then finally Paul alonge division manager ph# 561-200-3386 called me in may to tell me that they couldnt do my modification after all so I guess christina lied to me about my case. I am still waiting for my disengagment lettter to be sent to me and my refund. this was a waste of 8 months of going back in forth. this was a lot of drama so i just past what was said between me and luis over getting my refund back so everyone can see what I went threw 

 

 

this is what luis said below

Most likely because your lender has management who has to sign off on your modification. They can either approve or disapprove it. You misleading answer when I interviewed you was NO you have not received a mod.
 
If this was answered honestly at the time. I would of not accepted you case and we would of had to see the paper work associated with you temp mod offered by mortgage co.
 
So the truth always has a way of coming though in the long run. EMC (to me I am not the negotiator) caught up to you. I told you it's the lender who takes time to go through thier internal process. This has nothing to do with Chrissy this has everything to do with the fact you failed to tell me you had a MOD temp payment in place. We ask that from everyone. It's like asking for your name as we always ask if you had a mod in the past 12 months.
 
Come onnnnnnnnnnnnnnn Jen keep it real! Stop killing all of us over here. We worked hard on this file. You think we want to hear this from your lender? Believe me it's the last thing we want to hear.

And another thing  if I wasn't honest like your accusing me of being then why did it take your sorry company almost nine months to say that! Answer me that even though Chrissy from your negotating department told me that everything was looking good for my modification and she talk to someone from my mortgage company. I have proof of all of our conversation and will forward it all along with my complaint.

You are over reacting. This is not our fault!
 
We have been honest and transparent with you, Your bank is saying you stopped making your temp payments not us.
 
You did not disclose to us you even had a temp payment in place.
 
The certified letter comes in the mail. Making everyone miserable with this process does not change your lack of transparency you presented to us.
 
Allow the post office to do thier job and deliver the mail to you!

Hello Luis
I just want to let you know that if Paul or whoever is in charge in giving me my money back does not give my refund in a timely manner I will be calling the BBB and I will also get a lawyer to file a suite against this company. I am done playing games and if this detachment letter can be email to me I can sign and fax it back to you all so we can start this process. Thank you
