Leslie's claims, that as store managers on a salary they can classify them with "Exempt" status, force the store managers to work long 55+ hour weeks often times alone and with no breaks, thus banking huge amounts of dollars on labor and not compensating the managers for their time by 1 cent.

Fact of the matter is, by law (FLSA) there are conditions that must be met in order for a salaried employee to be listed as "Exepmt". With the duties that Leslie's store managers perform, the ONLY way that Leslie's could legally classify the store manager as "Exempt" would be if they continually supervised no less than 80 man hours of labor of other staff weekly throughout the year.

Any person that works as a store manager for Leslie's knows this is not the case, therefore, under law, ANY salaried store manager for Leslie's should be compensated for EVERY MINUTE worked over 40 hours of EVERY WEEK. Leslie's is fully aware of this law, and is the primary reason that store managers in California are paid on an hourly basis, since the employement law in California is much more liberal.

I highly recommend that any current or former store manager for Leslie's (or if you know of someone that is) be notified of this immediately and look into it for themself. Read the FLSA, anyone will be able to see that Leslie's is ripping them off and compensation is due to anyone that worked as a store manager for Leslie's outside of California. Stop letting Leslie's corporate greed benefit from your long hard hours of water testing, in store shop repairs, stocking out trucks, and those painfull inventories. Get the money from them that you earned and refuse to work over 40 hours without being paid anymore! Call your local Workforce Commision and/or Labor Board and file a complaint. What they are doing is wrong and it needs to be stopped ASAP.

Leslie's Pool Supplies (Leslie's Poolmart Inc.) is in violation of the Fair Labor Standards Act for managers that have not supervised at least TWO FULL TIME employees ALL YEAR LONG that are being paid a salary. Don't let anyone tell you that you are exempt because you make $433 per week. Your pay rate by itself does not make you exempt from overtime. If you have any questions you can call the US Department of Labor in Phoenix Arizona at (602) 514-7100. They can explain this to you. In my 6 years as a store manager working from 45-80 per week i may be entitled to $100,000 or more in back overtime pay. This means that District managers may be exempt from overtime, but they may want to double check anyways. Now Leslie's says that they are going to cut managers salary and then pay a premium pay of 1/2 there hourly equivalent which is still under the 1 and 1/2 minimum required by the FLSA. In my past employment with Leslie's I have fought for the tools I needed to make the sales they wanted. They cut by spendable payroll rate every year as my sales increased, and had to compensate with working long hours 70-80hrs/week all summer long. I suffered with antiquated and insufficient equipment to handle the customer load with the minimal staff in a satisfactory manner. If you think you may be entitled to overtime pay, please look into it for yourself. Leslie's like many other companies are always trying to get more with less. They spend a lot of time and effort in training us, to treat us like garbage and loose us. I left when my pay was reduced because i did so well in sales and hit my plateau at a sales tier, dropping down to the pay rate of 4 years prior.
