Since writing my original complaint regarding LifeTime Fitness I have filed a complaint with the Better Business Bureau. LifeTime Fitness had originally supplied a copy of a contract that did not include any mention of a Freeze Policy. This is the only contract I signed. The response from the Better Business Bureau to my complaint included a contract I had never seen that had a Freeze Policy limiting freezes to 90 days and to medical emergencies only. To my astonishment, they had cut and paste my signature to this unknown document form the credit card machine signature pad I signed at the club originally when paying my dues. This is total fraud.
LifeTime has sent me a letter saying I am not allowed in any of their clubs and that my membership has been cancelled. Again I never wanted it cancelled I wanted it frozen. They forgave the 200. in dues that had accrued while I was negotiating getting the membership frozen but refused to address the almost 10 months of dues I had requested a refund for I had taken out of my account without my authorization.
LifeTime also informed me that they would regard any contact with their staff as "harassment". When I sent a copy of the Better Business Bureau Complaint to Nicole Monty they immediately filed a local police report accusing me of "harassment". I got a phone call from a gentleman that came in under caller id "Private" and identified himself as a local police detective. He said that if I complained to any "third party" (such as the BBB or RipOff Report) that the club would open a case against me for "harassment".
I do not want to pursue this matter at this time. In life we need to pick our battles. I am 100% innocent of "harassment", and LifeTime is 100% guilty of consumer fraud in my mind but I do not want to subject myself or my family to these Machiavellian business tactics which are dishonest and ruthless to say the least. My lawyer says it would cost $2500. to $5000. to win this case and he said I'd get a judgement against the club. It does not make financial sense to pursue this unless a law firm would take up the cause with a Class Action lawsuit. I am sure many undeclared ripped off members of LifeTime across our great nation would join our case but this is not a crusade I am prepared to launch at this time.
