I traded my 2005 Honda CBR600RR in at a dealership called( Long Island Cycle and Marine) for a 2003 Ford Explorer. I was told by the appraiser and the sales manager that I would get $7000 for my trade. MR. Rollo who is the General manger / Finance Manger / Part owner and myself agreed on the Explorer being $12,799. Instead the truck ended up being $16,997 plus he openend a Kawasaki credit card for an additional $4888.12 for an extended warranty and remote start because he said that the bank wouldn't cover everything so he had to get the extra money somehow. He told me to give him $300 for the warranty and that he would throw in the remote start. Before he explained any of that he gave me a blank contract to sign. I told him that sounds like that's too much money if the vehicle was only supposed to be $12,799 plus my trade. He told me who cares if the car is $5 million dollars my monthly payments would add up to $355 in total including the kawasaki card. I didnt like that he said that at all. I asked can I have a copy of all my paperwork they told me it would be mailed to me, I never felt comfortable with that. When I asked if I could back out of the deal Mr.Rollo stated, "No, I already paid off your bike!" I went home and did the math and it ended up being more than what was told to me plus I check to see if the bike was paid off and it NEVER was. On top of all that the vehicle shut off while I was driving, it was very hesitant and making strange sounds when you turn.

I went back the next day and told them about everything the truck was doing so they said lets take it for a spin to see what happens. Instead they came back with coffee and said nothing was wrong with it and that they took it to the mechanic and he said everything was fine. While I was there I asked for a copy of my paperwork again and they told me the person that does all the paperwork wasn't there and that I should come back the next day. At that point I was very nervous an didn't want the vehicle anymore. I explained to him I didn't want the vehicle anymore because I was lied to about the price of the vehicle and I keep getting the run around with the paperwork and I don't feel at ease about the whole situation he mr. rollo said "no" I can't help you. So at this time he tried to explain how he came up with his numbers. He was telling me he had to boost the sale up $3000 because he couldn't show the bank I had negative equity in the bike. While he was explaining his numbers to me I realized he only gave me $6000 for my trade which made me really want out of the deal. I told him again I didn't want the vehicle and that I will return the explorer and take a cheaper car he said give me a second to talk to the owner to see what he says. Mind you he is part owner / finance manager / general manager. He comes back in his office and tells me the only way out is if I pay them $1000 "cash only "or the deal can't be made" for them taking the explorer back and them losing their dmv fees. He also told me that I could take my bike back. mind you he said that he paid it off already but then tell me I can have the bike back . Not only did I have to give him $1000 I had no other option but to pick out another vehicle I couldn't just walk away because I asked if I could pay him $1000 give the explorer back and take my bike and void the deal. He said NO they couldn't lose $1000 even though I gave them the money they said they were losing out on if they took the truck back. After I gave them the money they told me to go walk the lot start all over and pick out another car which I did. I found a 2002 Nissan Maxima. The price on that was $11,900 but they said they'll give it to me for $10,500. Mr. Rollo told me to wait until the next day to find out if I got approved for the car.

The next day I got a call from Long Island cycle and marine telling me that I was approved and that I needed to come down and sign the paperwork. When I got there I was told the only way the loan could get processed was if I take an extended warranty because the bank wanted to make sure if for any reason they had to repo the car they would be able to resell the car for a high value and get their money back. I asked Mr. Rollo if I called the bank would they verify what you just told me and he responded, Absolutely!. I believed him because he made everything sound true and that he was actually being honest. I asked would my loan for the explorer and kawasaki card be paid off and he told me that was the only way he could get the loan for the maxima. Just so I would feel comfortable he gave me a letter stating that my loan for the 2003 Ford Explorer and the Kawasaki card would be paid off upon the delivery of the maxima only . A couple of days pass and something told me to call the bank and ask them if I could remove the warranty and they told me, what warranty we don't deal with warranties you would have to talk to your dealer about that. I told them that the dealer told me that my loan couldn't be processed if I didn't take the warranty. They told me that was absolutely false.

At this point I was felt upset, taken for a fool and lied to for like the 10th time. So I wanted to know what else was I lied to about. I asked my uncle who is a retired chevrolet dealership owner about the whole situation and he told me that I should not have given them any money because used cars don't lose value such a short period of time and I didn't exceed 3000 miles on the vehicle. He also said that I don't have a bill of sale for either vehicle, lemon law papers, or warranty papers. The paperwork (mv-50) I do have doesn't state the odometer reading and thats a violation on the dealer. He also said it's unlawful to make people sign blank contracts and to force/lie warranties on them. He told me to get a lawyer or a legal aide and to take the vehicle back to the dealer. Instead I went back to Long Island cycle and marine with the police to try to return the car and they wouldn't take it back. Mr. Rollo said that he told me why the vehicle was what it was. He was talking about points and raising and lowering stuff that made no sense to anyone that was in the room. I guess because the police was there he told me he would take off the warranty but he said if he did that he would have to raise the interest rate from a 11.99% to 15.99% and charge $675 for a make and model fee. When I called the bank to see if that was possible they told me no that can't be done. He cannot raise the interest rate. Also other used car dealers that I spoke to told me they have never heard of a make and model fee and that he (Mr. Rollo) is just trying to rip me off as much as possible. Mr. Rollo told me to come back on the following day so he could take the warranty off. I went back the next day and he told me he took care of everything but the price of the maxima still remains the same. He told me if I wasn't happy with the way they were doing things that I should take them to court but Mr. Rollo told me that if I report/sue Long Island cycle and marine that I would be sued personally. How can I be sued for them not doing their customers right? I've been calling them everyday to find out why my loans and warranty on maxima have not been paid off and everyday it's the same story. They tell me that it's been done, I've sent them a check it should be paid off by Friday, The person that handles that is not here, I did a payment electronically, your file is lock in the office. Honestly I feel I've done as much as I can do. It's now out of my hands and I don't know what else to do but I refuse to sit back and let my credit get destroyed over these scam artist. I just want them to pay off the explorer/ Kawasaki card / maxima loans and take their maxima back and fix my credit THAT'S ALL I WANT.

As a matter of fact on the maxima the service engine soon light comes on dim, the brakes don't work that good, and it also makes a knocking/rubbing sound when you turn. I have a 9 month old child I can't drive around in a car like that with her in it. This is completely unacceptable. I have been very humble and peaceful with these people but that doesn't seem to matter to them. I just really want out of this deal I hope you guys can HELP ME PLEASE.

I recently called them on 2/1/07 to ask one final time why hasn't my loans/warranty been paid/taken off and Mr.Rollo told me that he was going to "ONLY" pay off the explorer and kawasaki card and that he (mr.Rollo) was not going to do nothing about the warranty on the maxima and that's final and that I can call whoever want about it and he does'nt care . But something told me not to believe him so instead I called the bank myself and asked one of the reps was it paid off and she told me no. So what I did was I called him 3-way and he told her some bogus excuse that the check was sent to the wrong address and that he resent one out that day 2/1/07. When I asked him about taking off the warranty on the maxima and paying off the kawasaki card he lost his mind and started screaming at me and the bank rep telling me that I can never come there or call there never ever again if I do no one will help me . But what I don't understand is if you did nothing wrong and have nothing to hide why are you getting so upset and acting like a 5 year old and hanging up on your customer and primary bank lender.

At this point I'm fed up and I've already reported them to NYS DMV vehicle safety department, I'm going to also report them to CW11 news to help me howard and other news channels

UPDATE: I spoke with kawasaki bank dispute department 2/6/07 and I was told that NOBODY at Long island cycle and marine was allowed to use / issue a Kawasaki credit card for anything involving a car. So I was told that my account was credited to $0.00 balance and that Long island cycle and marine is now responsable for paying the bank back $4888.12 .

I spoke with Mr. Rollo today 2/10/07 I would like say that my complaint was a big misunderstanding and that Mr. Rollo general manager of long island cycle and marine is not faulted in any way and on monday 2/12/07 he is going to be helping me with/fix the issues I complained about. THANK YOU VERY VERY MUCH Mr.Rollo DWAYNE.
