Well Thanks for eveything but I don't really know where to start. I know you have told me to get a lawyer but I just feel like I don't have all the evidence to back up everything. I mean the wage garnishment happened over 4 years ago and I have moved since then and know I don't have the papers that were served to me at my job...how embarrassing! I read the FDCPA and thats all foreign language to me. It like reading greek. So I just call a lawyer and tell them what happened? *Also I was reading Budd Hibbs and he has a cease-comm letter. Is that something that can be sent to collectors like the few I have on my credit report or is that just opening a can of worms. I saw where UNIFUND was also horrible, the last time I checked my report they had bought a Providian account I had several years ago, Are they hiding in the dark getting ready to get me too? They're saying I owe them $3000 which is total crap, when the credit cards I had at the time were never over a $500 credit limit.

Jennifer, The main rule to remember is to NEVER call, or speak to any debt collector on the phone. NEVER!! It will never do anything positive for you, and will always make things worse. The cost of a lawyer will be recovered when you win. These fools are easy to beat, and it is very easy to get paid on FDCPA violations. They always settle out of court. They put you right where they wanted you, counting on the fact that you did not know your rights. You need to educate yourself on debt collections and junk debt buyers. Go to budhibbs and read all about them. You may be suprised to see the thousands of blatant violations these companies engage in every week. Go to the FTC.com website and read the FDCPA.

I think that trying to get a lawyer would be even more expensive than what I ended up losing with those idiots. I even tried to get more info from Capitol One after I found out about the lien and they wouldn't even discuss the account with me, saying they had sold it to another company. They said they couldn't even find an account under my social security number but 2 weeks prior to that they pulled my account up to tell me that another agancy had bought it then they sold it to MANN BRACKEN for I'm sure pennies on the dollar. I want to know my rights but who can trust a lawyer, they seem to be crooked as all get out to.... I had some other debts at this same time that either got written off or are on my account as a collection. I just wish I knew some way to get this stuff off of me without opening a can of worms, like I did with MANN BRACKEN. God forbid if you get in a tight and can't pay a bill. You get treated like a kid.

Jen, These are some real lowlife you are dealing with. You should have challenged them every step of the way from the first contact. NEVER pay a junk debt buyer or third party collector, and NEVER speak to them on the phone! FYI..It is totally impossible for a $300 bad debt on a credit card to turn into $1500. It simply cannot happen legally. By law, a credit card company MUST "charge off" any account deemed uncollectable 180 days after the first major delinquency which is considered to be 30 days late. This means they can charge the max default rate outlined in your card agreement until date of charge off. After that, the interest can only be that which is set by law, at last I checked it was either 6% or 8%. And also, the only way they could have garnished your wages was to first sue you and win. NEVER let these bottomfeeders put you over the barrel like this. I would have held off on the refinance. FYI..The mortgage company could have just made a stipulation on this and paid them out of the proceeds of the refinance, or the underwriter could have made an exception for you with a signed statement saying the debt had already been satisfied, along with some documentation of the prior garnishment. It is obvious they have violated many laws here, and I would get a lawyer right away and sue them for your damages.
