It amazes me that people get caught stealing and want to run to this site. It also amazes me that your fianc didn't submit this himself because you are only subjected to what he told you. I know for a fact that you weren't in the office with him but you report as if you were there every step of the way.
If it were only $1.09 worth of merchandise, he would not have been prosecuted unless he had more stuff or he gave false information to the officer. We don't waste the time of Police if it is "petty" petty theft as you describe. If did nothing wrong, your attorney would have shown that in court.
Caution should be used when trying to make others feel sorry for you. This is the information age and browsing through the Clermont county court page reveals the truth. Also, as an employee in an Ohio store I know that losing your license for petty theft is not part of the Ohio Revised Code (ORC). That is unless, he stole gas. Fortunately for him it was reduced to "attempted" as always because he got caught. He is lucky that he wasn't sentenced to 6 months in jail and or a $1000 fine as outlined in the ORC. I hope he learned his lesson.
By the way, saying that the store, "hired a bunch of retarded kids," only shows your level of intelligence. Good Day!
