I have owned Mercedes-Benz vehicles for over the past 10 years getting a new vehicle ever 2-3 years. I have never had a need for warranty repair until now. What a complete failure! My 2013 S-Class left my wife and kids roadside nearly 2 weeks ago. Towed to the local dealer, 24hrs later I told that my 1 year old under warranty S-Class will not be covered and the repair will be $31,000+ due to lack of oil change. That is simply not true other than I did not have the oil changed by MB! I contacted corporate MB to dispute the dealers statement that the repair will not be covered under warranty. I was told someone would call me back within 24 hrs. The following day I heard from someone who captured the information and told me she would handle it and I would hear from her soon. That was 10 days ago.

No return phone calls! I called this corporate contact 4 days ago for an update and she informed me she has no update for me and would call me back. No return phone call! It has been 12 days, we are without our S-Class, and I have been renting a car myself while waiting on MB. I am disgusted by the poor service provided by Mercedes-Benz! This is supposed to be a luxury brand that you pay a premium price and have an expectation of better than average service. That could not be any further than what my experience is. This is the first time I have ever needed warranty of a Mercedes-Benz and this is a complete and utter failure! It has come to an attempt using social media to reach someone at MB that cares to service the issue since the "normal" channels have yielded my no results not even a return phone call.

First, let me complement you on the very well written report!  Contrast that to the other types you find here...no punctuation, run-on sentences etc.

If you have proof you had the oil change done, then you have an excellent case!  Under the Magnuson-Moss Act, you can have any maintenance work done anywhere or even do it yourself and your factory warranty is NOT voided!  The reasons you may not have a case are you exceeded the oil change mileage limits, used the wrong grade of oil or used the wrong oil filter.  They will try to hang you on those matters.  The "voided warranty" con-game is regularly practiced in the Sleazy American Car Business because the average person has never heard of their rights under the M/M Act!  The dealer knows about the M/M Act and they hope you are too stupid to know!

My advice would be to do some reading on the net about this Act.  Make sure you have the physical proof of the oil change, (receipt) then inform the Zone Office you intend to pursue your rights as per the M/M Act and they can either comply or you will get an attorney.  If the Zone Office says they will honor the warranty, I highly suggest you tell them you want a different dealer to do the work to avoid retribution.  You may chose at this point to seek legal representation now, before informing them.  If so, be sure you look for an attorney who has practice experience within the M/M Act.  Perhaps there will be a way for you to recoup attorney fees because of their failure to comply.
