In March 06 I recieved an email in regards to a free bottle of Metabofuel. I paid $4.87 for shipping and recieved the bottle. About two weeks later I recieved a charge of $106.82 to my account and then another charge of $99.99. I was able to dispute both of my charges through the bank and recieved my money back. Metabofuel has fought the matter and is trying to recharge my account. When I went to the web site I could find no such offer of the free bottle or any terms of conditions. I also could not locate a phone number to contact them to advise them that I did not want any more charges to my account.

Today(May 18, 2006) I recieved a letter from my bank showing where Metabofuel is attempting to recharge my account. I also recieved a copy of the terms of conditions for the sale.

On one part it states "ALL SALES ARE FINAL. SHIPPING AND HANDLING IS NON-REFUNDABLE. PACKAGES MARKED RETURN TO SENDER WILL NOT BE PROCESSED OR REFUNDED" How in the world can all sales be final?

The other part states "IN THE EVENT THAT A CUSTOMER INITIATES A TRANSACTION DISPUTE(TYPICALLY WITH THEIR CREDITOR/ISSUING BANK) AND THIS DISPUTE IS LATER REJECTED IN FAVOR OF THE MERCHANT, CUSTOMER AGREES AND AUTHORIZES METABOFUEL 1000 TO BILL THEM FOR TRANSACTION RESOLUTION FEES. THESE FEES SHALL BE NO LESS THAN 10% OF THE TOTAL DISPUTED TRANSACTION AMOUNT, WITH A $25.00 MINIMUM" I found out today through my dispute company that such actions are illegal.

My dispute company advised me to contact them through telephone to go on record of my intentions as well as getting code to send back the additional bottles that I did receive as part of THEIR agreement, not mine. He provided a telephone and I have no clue who I called. It gave me an error message. He was able to contact someone by telephone and we both we able to talk with a representative of the company, who by my standards appeared to be a complete moron. After arguing with the mental midget for about ten minutes he provided an address and a cancellation code. I have no idea how good any of this is going to do.

Basically this is a clear case of sneaky tactics used on the internet. Always read all terms & conditions before submitting payments. This has ruined me from buying any offers on the net. Its an old saying, but best applies here "If its too good to be true then it probably isnt so"
