Complaint Review: Midland Credit management inc. MCM - san diego California

I am not a lawyer and I don't go into court rooms and watch how things are done so I didn't have a clue how to help at first BUT, I found a group of volunteers that let you ask questions and tehn point you in teh correct direction down at the Library downtown. 

   

   WOW what an Eye Opener!     These folks really went to court over this. It was amazing, I guess they thought I was not serious, My Neigbor was so nervouse it was insane becuase she had been harrased about this for a long while and illegal actions had been being inflicted on her because of her age and her level of understanding of this matter, they thought they could steal from her. It really was working, If I had not helped I hate to think of what would have happened.  Iknow it happens every day, these guys are serious crooks and they get millions a month doing this to people. 

Like I was saying, we went to court, the whole thing was over in LESS than 10 Minutes. The judge asked the companies representative what they had as proof and this is exactly what they said. " We have reviewed our Records and discovered that we have the wrong person, this womans Name is common and the name we have does not have the same Social security number as this person in the court today"    I didn't have to say anything at all, the whole thing was dropped, they were not ordered to pay any type of restitution and the company was free to keep doing this as they do every single day.  The Judge did not even ask them to appologise in any way shape or form. 

    It appears to me that this company Buys debt for penny's on the dollar. They Buy debts owed by people with names that are fairly common, they run a search on the name and get a list, the list will have the persons name, age, place of residence and other information.  then from those names aquired they research to see who in the list would be most suceptable to thier techniques for collection ( even thought those people do not have anything to do with that debt) they start in on them and hope that the amount is Paid with no contest, they are extremly persistant and if it ends up going to court they will show in hopes that the person is a no show, if the person shows up they drop it to save face, if the person does not show the win by default and then they have a valid judgment!  

   I am not kidding.  This is exactly how it works.    It's super common. 

Good for you trying to help your neighbor. The same thing happened to me and I won against them in court! After I received a letter from them I requested written proof of the debt by certified return receipt mail. They ignored me. All of the sudden I get a summons so I go to court. When I show up, there are 30 people there and one attorney representing Midland. They all looked really scared And started making deals to pay their "debts". Whe it was our turn we said no deal and asked for proof of the debt. The attorney had nothing! We showed the judge our certified return receipt signed by Midland and we won. We are part of a class action against Midland. They are bullies and they are not following the law. Here is my advice, I am not an attorney, (but I play one on tv... Just kidding) but I have done tons of research and I won in court against these monsters.

1. Do not talk to them on the phone. They lie and you have no documentation. 2. Request proof of debt by certified return receipt. 3. If you get any court date or notice do not ignore it. 4. They have to provide proof of debt and most times they Do Not Have It!

They are counting on people not showing up in court and and being afraid if they do.
