The very first time I called the lot intrested in looking at an Audi, there were several Audis on the lot, a gentleman answered the call and became iirritated by the fact of me asking the prices on the cars, he says " you already asked about 4 cars now, just tell me the price your looking for." So I stated that there were 6 audis on the lot ranging from 2000-2008, and that I wanted the best value for my money, Am i wrong in asking. He says "yes, you are irritating me." I hung up called back and the owner apologized saying that guy will no longer work here. I scheduled an appointment to come in. I test drove the 2000 A6 , put down a deposit, started the paperwork for financing. Never heard anything,I called, I didnt get approved so I told them I would do a buy-here pay-here with 4 grand down he accepted so i told him my pay period was the following week , It was understood that the deposit would hold the car for the week. After leaving work I saw the car still on the lot and showed my sister the car. My sister went over and looked at the car just to look, and the sales guy approached her and attempted to make a sale on the car. I called the lot to confront the sales guy, not only did he tell me of the no refund policy, but the car had been sold. I was not granted a refund on the car. Not only did he take the money, he also showed the car, so the car was never heldwith that deposit.

Sounds like a great small claims court case. Either the deposit was refundable, or it was to hold the car. They did neither, so they owe you your money back. Chances are good you'll get it back as soon as they receive the court summons. Right now, they're just hoping you'll go away so they can keep your money. In the future, don't give a dealer a penny of deposit without something in writing that details whether it's refundable or not.
