Thank you for visiting the FTC's web page and for using our NEW electronic Talk To Us form. Here's what happened to your information after you sent it to us: One of our consumer counselors reviewed the information you sent us. If it was related to the FTC's law enforcement responsibilities, we entered it into our shared law enforcement data system. We share this data system with law enforcement agencies throughout the United States and Canada. Attached is your electronic response, which includes your reference number. Any enclosures can be found at www.FTC.GOV under the News Releases, Publications, Speeches option. Information from consumers like you helps Federal, State and Local authorities investigate possible illegal practices and enforce our laws. Someone from the Federal Trade Commission or another law enforcement agency may contact you if they need additional information to help them in an investigation. Thank you for using our Talk To Us form, and please continue to use the FTC's web page, www.ftc.gov, to get free information to help you avoid costly consumer problems. Report them to the DA's office as well. I will be running an ad in the St. Louis Post Dispatch some time in October with my name and phone number so that we can get a class action lawsuit against them. I will also be outside their Webstor Groves, MO office with placards letting people know to beware of these crooks. I have nothing but time. They will go down.

This is appalling. I have a former post here on the board as to how they held up the payoff figure, in my opinion, giving all kinds of bogus excuses to myself and the realtor, that we lost the short sale on the property. The deal had gone so far that a settlement date had been set! Suddenly Aurora sent a figure so high it was ridiculous and the buyer was long gone by that time. It is unfortunate, but unless those who believe themselves victims of this company chose to sue on their own, a class action lawsuit is the only way to go. I say it is unfortunate because in so many cases, the victims have to settle for an amount in a ridiculous proportion to the damage done. However, if this is the only way to bring a lender to heel, so be it. The Household Finance settlement--the full reports of which are available on the internet--gave small monetary awards but did force the company to make some major changes. Perhaps in the end that is what we will have to settle for--an award that comes nowhere to assuage the damage but will bring about massive changes to this lender's policy or--what really should happen--pull their corporate charter for good. There's some good class action firms out there--time to do our homework. I wish everyone good luck. If we don't act, there will always be potential victims waiting in the wings.

Received a phone call Tuesday from our mortgage broker. Apparently Aurora Loan Services wasn't happy with the final dollar amount that was paid to them. September 3, 2004, I had my first closing with the new mortgage company. The next day, my broker called and informed me that a mistake was made (Aurora Loan Services) and the numbers that I have and the forms that were signed are not good. An additional $12,000.00 was added - you know the usual attorney fees, return check charge(?) unidentified items. If I didn't have the additionall funds by the next day, I lost my home. Thankfully my boyfriend's daughter took a loan out for the full amount that was added. No groceries again this week. Thought that I was finished - silly you - NOT. Tuesday an additional $2300.00(roughly a little more) was added. This time attorney fees. Never mind that HUD frowns on things like this. Their attorney faxed an itemized bill - amounts add up correctly - they even gave me a credit for their fee. Then the itemized bill from Aurora Loan Services. The final amount is close, they added the attorney fees, even though they were not charged, undisclosed charges, taxes for the full year 2004 and 2003 were not paid yet. Even though the taxes were in escrow. This is a big no-no. Forced to pay the additional amount or lose the house. All final now ( I think) and now it's my turn. Fifteen mortgage payments in thirteen months. That makes me 2 (two) payments ahead. National City Mortgage kept the payments, never sending them to Aurora. Aurora now foreclosed on the 2 payments that National City kept. A little advise - keep copies of all letters to them, and all from them. Write down names of all fools that you try to talk to. Let them laugh at you, I told one fool that I refuse to have a battle of the wits with an unarmed man. He hung up on me. Getting mad gets you nowhere. GET EVEN. CLICK here to see why Rip-off Report, as a matter of policy, deleted either a phone number, link or e-mail address from this Report. Do I hear class action law suit?! Wish me luck. Best of luck to all of you.

You took the right steps, especially finding an attorney well-versed in this area and who will not back down. Thank you for posting this encouraging report and letting consumers know that they can win if they are persistent and get proper legal counsel.

The sheriff sale was August 26, 2004. Our attorney did not return our phone calls the day before or the morning of the sale. We had to contact a 3rd attorney. There were no bidders on the property, so the sale was on hold for 7 days. We had the paperwork for the refinancing with us, all of the loan papers and the letter of committment. That did not make a difference. The attorney for Codilis and Associates told the sheriff that he would not pull the sale, even with the proof of refinancing. The last and 3rd attorney was able to reach the attorney at Codilis and asked him if he wanted further litigation. He was preventing us from purchasing/refinancing our home by not providing us with a final pay out amount. He did find this funny, and did fax a final amount. Our cut off time was 1:00 p.m. and the fax came to us at 12:46 p.m. Don't take no for an answer, keep fighting for your home. There are great lawyers and you just have to keep looking. Consultations are usually free or a minimal charge. Check back here for a reference before you sign the final papers when you buy that house.
