My husband and I successfully completed the program about a year ago, after 5 years of making payments of $799.00 per month. Our deposit was also $799.00. Our experience was very similar to yours...right down to getting a refund from American Express. We, too, faxed all of the necessary documents to prove that we had completed the program. We, too, got the same song and dance about them being back-logged, blah, blah, blah. I finally had enough and started demanding some answers. I was told that NCRC had contracted with another company to initially set-up the consumer accounts. NCRC then kept up with the monthly maintenance of the consumer accounts and disbursed the payments to the creditors. NCRC informed me that the other company had went out of business, taking everyone's deposits with them. It is important to note that this company was located in the same building as NCRC. When I asked NCRC why we weren't notified that they had gone out of business, I didn't get an intelligent response. I then reminded them of the contract that both my husband and I, and a representative from NCRC had signed. NCRC told me that they weren't responsible for refunding the deposit as they had never kept the money. Upon reading the fine print on our contract, I realized that it didn't specifically state that NCRC would be the company sending us our refund check. I decided not to wait any longer and pulled out the big guns! Meaning that I filed a complaint with the Wisconsin Department of Financial Institutions. Here is the link for the State of Wisconsin: wdfi.org/contact_us/complaint.asp. Every state should have something similar. They didn't promise us anything, but did send a letter to NCRC on our behalf. Low and behold, we had a check for $799.00 within a couple of weeks. All in all, I am thankful that we found NCRC as our $35K in debt is just a bad memory. The couple of credit cards we have are paid in full on a monthly basis, and we are doubling-up my husband's auto loan payment in order to pay it off quicker. The only negative effect that enrolling in NCRC's program had on our credit report was with American Express....humorous as that is, being that they were the only creditor that sent us a refund. Good luck, and I hope that you're able to get your refund!
