loan #xxxxxx85A26  I had paid off a 6 year note (72 payments)with this company, Navistar Financial, @ $1889.70/mo. on Monday 5/7/12 at 1000am with a wire transfer from my bank.(Final payment amount $2380.00) 1st payment due date 5/18/06 72nd payment due date 4/18/12 Navistar escalated these last few months of collections for the remaining few months that were sometimes late a couple of weeks, but never a couple of months. Their retail collector Dana Nicholson placed my account into repossession after paying almost $150,000 even after numerous email conversations of my intentions of paying the loan in full.

Even after the final payment was completed, Navistar still decided to send the repossession team to my home to seize my truck. After showing the repo team my receipt and them confirming by calling their office, they, the repo team, agreed it was paid in full and left the premises. An incident avoided.

I called into Navistar on Tuesday 5/8/12 and spoke to Frank in customer services of Navistar to confirm all was completed. He agreed and said that Navistar was going to UPS title in 2 days and to expect it on Thursday or Friday. On Friday 5/11/12, after not receiving title, I called Navistar and was connected to Dana Nicholson and was told that she was not releasing my PAID OFF title because she says I owe $29.00 more. I was never notified of any additional $29.00 fee and the final payment, which was made 19 days late of final contract payment due date, was the amount I was told by them, Navistar.

I believe that after being told by the repo people and Frank in Navistar's customer service department that the loan (150,000.00 plus or minus) has been completed, again 19 days late, not enough to send out for repossession after 6 years of nearly $2000.00/mo. payments and for owing ONLY ONE(1) months payment with all their additional late charges and whatever other costs they applied, (My estimation - another $2500.00.) I also believe that Dana Nicholson has a vendetta towards me and is out to prove a point, as she had stated in our phone conversation, that she is not releasing the title and has placed this fictitious $29.00 fee on my account to hold the release because "I did not return her phone calls."

Again, this complaint is to confirm that Navistar's (BBB rating of D-) position and Dana Nicholson is to NOT release Power Cool INC. (BBB Rating A+ Accredited Business )title for above subject, which has paid nearly $150,000.00 over a 6 year period, for the reason of "Not returning my phone calls" and a false charge of $29.00 for some thought up reason by Dana Nicholson. There was never any mention of any additional fee of $29.00 and to hold my title ransom for said amount is illegal and in direct violation of retail Guaranty Agreement. No notice for any additional fees, as per item #15 in Guaranty Agreement, were received by me or anyone in my office.

In closing, I find it appalling that Navistar resorts to predatory practices of taking payments on loans and then decides to repossess vehicles when 99% of the loan has been paid. Times are tough and everyone is struggling and I am, by far, NOT a deadbeat as Dana Nicholson may want to think. To be treated as one disgusts me. I believe that Navistar and Dana Nicholson have abused their power in this matter. All because I didn't return her phone calls. I guess the emails that I was sending didn't count.

As I stated above, times are tough and money is tight. I am a small business only looking for what I have paid a lot of money for, to sell, and take my hard earned proceeds and pay off my bills. The economy is horrible, my sales are down, and I am trying to pay my bills, most importantly, my familys health insurance which is about to be cancelled for non-payment. It is appalling and disgusting that Goliath Navistar, thru their self-absorbed, power hungry, different agenda seeking, egotistical retail collector Dana Nicholson, and her partner in crime David Martin (The Grim Repo) business practice is to steal back what they were paid for and auction off and double their profits for 1 truck.

As of this posting, I still have not received my title or a return call from them. They have all my money AND the title. Go Figure.
