This company has been calling here several times a day. It is an automated system and no matter how long you wait, no one ever comes on the line. I call the number back from another phone and inform them that this is not our bill. They always tell me the same thing, "your number has been deleted from our database". Obviously it hasn't because they still keep calling.

Today they called twice within two hours and I was told the same thing each time. The man I was talking to the 2nd time said that they had not called this number before. He said the number was not even in their database. I informed him that the number I was calling from was not our home number, and he then told me to stop calling in and reporting false calls . I asked for his supervisor and he refused to transfer me, he said there wasn't one available and he hung up on me.

I called back again and supposedlhy reached a supervisor named Sally. She was also extremely rude and said that obviously all I wanted to do was argue and she didn't have time for that. She ended up hanging up on me also.

These people are nothing but scum sucking bottom feeders and they don't care who they hurt or harrass.

I have listed a letter below that you can send to any of these type of people, but you have to send it certified, return receipt requested. Just change the personal fields and put in your own information. I got this letter from an attorney and have used it in the past and the contact stops immediately. Or is that something YOU made up to try to make YOUR point instead of sticking to the facts at hand? Nice how you used all the Bud Hibbs punch lines (Is HE going to represent you personally when NCO sues you successfully to collect on a validated debt? Oh that's right...you have your own 'attorney'. Sleep well... ) - except that NCO does not handle only Sold accounts. I work for a major worldwide telecom and can tell you for a FACT that ALL debts we refer to NCO are legit and include all billing information and documentation required to validate the debt. Sure, the consumer can demand that we deal with him directly...so long as he can secure the account with the exact 14-18 digit account number from an account that is usually anywhere from 1-4 years old (Do YOU have those old bills?). If he can do that, we'll collect from him directly. If he cannot, off to the outside collection agency he goes - and he has absolutely NO recourse as per the Public Utility Commission regulations of his state. This is not to say that NCO does not buy debt from someone out there, but they also collect legitimate debts so you had better be very careful when assuming that the letter they send you is for a sold or uncollectible debt. READ (yes, READ) the OP thoroughly as I did and you will familiarize yourself with the contradictions of his assertions. If you still cannot comprehend this, just let me know and I will draw you a picture in crayon so you can better understand. As far as being an attorney...nope, sorry to disappoint you. I do have a Master's Degree in Public Policy from a Big Ten school, and therefore have the intelligence and education to understand that I do not need an attorney to sue a bottom feeder if they fail to abide by a CEASE COMMUNICATIONS (there is no such thing as a cease and desist letter where federal collection law is concerned). I can do that myself and collect in Small Claims Court - WITHOUT paying a lawyer. That, little girl, is called intelligence. Look, I think that collection agencies are the worst of the worst when it comes to Americans. They prey off of fears and break every law they can to collect money. However, if you owe a legally-collectable debt and think they cannot credit report you or sue you and win, you are living in fantasy land. They HAVE done this in the past to people who have a credit score high enough to justify harassing for the debt (Just ask anyone who mistakenly paid on a sold account - then found themselves being served weeks later). Maybe you should find an attorney that did not get his law degree from a Bazooka Joe bubble gum wrapper. You claimed to go to Bud Hibbs' website to get this so-called 'cease and desist' letter for dealing with bottom feeders. Funny, but Bud has this letter listed as CEASE COMMUNICATIONS...just as I said...and that letter in no way ensures that the collection agency cannot credit report and/or sue you to collect a validated debt. They may stop calling you as required by federal collection law - but as many consumers have found out the hard way, if you ignore a summons to appear in court when sued for this debt, the court can and will garnish your wages to collect the debt. Here endeth the lesson, little girl...let me know if you or your night court attorney need any other schooling.

In most cases, I write to inform ROR readers how I detest bottom-feeding, scum-sucking collection companies like NCO. I work for a large national telecom that refers collectable accounts to many OCAs and sometimes sells debts outright to others. Sometimes, I have to call the OCA myself to straighten them out if they jerk a former customer around. However, there are alarming inconsistencies with this ROR... First, the OP states, 'I call the number back from another phone and inform them that this is not our bill.' But then he states in his letter, 'I have decided that I do not desire to work with a collection agency under the circumstances. I will contact the original creditor to resolve this matter directly, should circumstances warrant.' Excuse me...but if the bill is not yours, exactly how could there be an original creditor - and what would you be working with them to resolve? Your letter is humorous but nothing more than a pathetic exercise in futility. Much like telecom customers I work with who dispute correctional collect calls accepted by their children because THEY did not authorize them. Nevermind that their irresponsible offspring burdened them in the first place - or that legally THEY are responsible for all charges incurred within their residence (take your kids to court of you do not agree with the charges THEY brought upon you - but sorry, we're not going to pay them for you) Those idiots then threaten to sue and defiantly say they won't pay the charges..until those charges end up on THEIR credit report months later and stay there for seven years even if they do pay them. You cannot dispute a valid, unpaid debt that has been credit reported no matter how many letters of waste you write. Quite frankly, if you do not pay a validated bill you have NO right to demand much of anything short of documentation validating the debt - and I sincerely doubt that any lawyer who didn't get his degree from an Apple Jack's box would tell you otherwise. Creditors can and will refer or sell a valid debt to outside collection agencies - and can legally refer every subsequent inquiry to the OCA because collectable referrals typically get the billing documentation. This sort of snide, arrogant letter is exactly the type of catalyst that leads to lawsuits and other adverse actions against those who fail to pay debts. You would do well to jettison it and proceed in a less-arrogant yet more professional manner. FYI...the Cease Communications letter allows the collection agency to send one last correspondence via U.S. Postal Mail within the subsequent 30 days of receiving the letter to advise you of their future course of action. You had better make sure that the debt is not yours and within your state's SOL...or that communication may well be a notice to appear in court. Wise up pal...

The original poster said that the bill wasn't his so isn't the cease & desist letter appropriate? I've used it in the past with sCAMCO (now closed) and that ended any contact from them. The main difference is that I requested a validation of the debt and told them to cease and desist all contact unless and until they validated the alleged debt.

That letter is kind of a joke and, much as I HATE to agree with a debt collector, Jonathan was pretty much correct. Whether or not you can still deal with the original creditor depends of how the debt collector was given authority to collect on it. If the debt collector is working on a contingency or flat fee basis, many times you can still deal with the original creditor, but they are not obligated to deal with you directly. In this case, gleaning from Jonathan's apparent inside information, NCO purchased this debt. The debt therefore no longer belongs to the original creditor and you CAN'T deal directly with the original creditor. Also, a collection agency IS, in most cases, authorized to review your credit reports, whether you tell them they can or not. Sometimes a cease and desist letter is not your best option. You're basically forcing the collector's hand by sending one. If they can no longer communicate with you, their sole option is to sue you. You can send "limited" cease and desist letters, insisting that all further communication be in writing, or that all further communication be directed toward your attorney. The only cases wherein a cease and desist letter is definitely your best option are where you can PROVE that you do not owe the debt, or where the debt is past the statute of limitations. In all other cases, there is a risk involved with cease and desist letters.

I work for Commonwealth Financial and I absolutely love the stuff people come up with. That meaningless letter that you posted is hilarious, I received it a few times. In the letter you're declining working with a collection agency and will work with the original creditor to take care of it, thats the part that cracks me up. You had your chance to work with the original creditor and you lost that right when didnt pay them so they got tired of you and sold your debt because they couldnt get you to pay. If you paid your bill the first time you wouldnt have this problem. You had no problem running the credit card up to $3,000, but now that you are being made to pay, you dont like that and want to work with the original creditor when in fact, they dont want anything to do with you because they sold your debt off. There are a few debtors out there that actually have fallen on bad times and truly cant do anything, but the rest of you are all the same, looking for any way out to try to beat the system. stop playing the part and pay the bill...
