On December 29, 2006 my escrow company was ready to payoff my loan I had with Litton Loan Servicing. Litton would not except the payment because my loan was sent to Ocwen. On January 2, 2007 I spook with a supervisor by the name of Anoop at ext 4369 in India and was told Litton had not sent the files over yet so we can not give you a payoff amount.

At this time my payoff amount was $649,609.77. Anoop had me fax over information 17 pages of the previous loan to "speed up the process". After several weeks speaking with Mr. Anoop I gave up and contacted Robert Snoke(payoff resolution) in the United States office. He assured me that they would back date the payoff to the December 29, date.

My escrow company informed me on January 16, 2007 that Ocwen payoff amount would now be $652,866.41 a difference of $3256.64. I spoke with Mr. Snoke on January 17th and he quickly back out of the December payoff amount and said he could not help me and I should contact a Kanetta Lewis at 407-737-5595. I have left a message with no return call.

While Mr. Ciabirro was telling they had no information on my account to give a payoff quote I received a letter from Ocwen dated 1/10/2007 advising me of the "notice of assignment, Sale of Transfer of Servicing Rights. Mr. Ciabirro and Ocwen are in violation of the Real Estate Settlement Procedures Act (RESPA). What this did for Ocwen is to earn over $172.00 per day by not giving a payoff amount. This no doubt seems like an upper management standard operating procedure to generate revenue by telling us the information is not available. It also appears all departments have not been briefed on this money making scheme or they would have not sent me out the letter stating that they are my new service provider with an account number to match Mr. Ciabirro said was not available.

Ocwen Upate on 3 weeks for payoff.

January 17,2007 I contacted the Presidents office for Ocwen. Ronald M. Farris is the president but of course I spoke to his secretary who told me my problem would be easy to handle and transfer me to a Jamie Ciabirro. Mr. Ciabirro heard me out and said he would need to speak with his "investors to see what we could do". To my surprise I was called later that afternoon. Mr. Ciabirro told me he had good and bad news. The good news was they received the payment. (my escrow has been trying to pay this off for three weeks) The bad news was the "investors would not allow him to back date my payoff". Industry standard for loans to be tranferred is 5 business days. Mr. Ciabirro was able to contact his "investors in less then 5 hours". Mr. Ciabirro went on to give me a lecture on what my people should have done to fund the payoff so I would not lose my money. It's obvious these people are highly trained in placing blame on the customers. Ocwen must be stopped. The good news is they have lost at least two major cases last year and will probaly lose a few more this year. The class action suits pending will take a while. They will lose on all fronts. I really don't think is does any good to call Ocwen to resolve serious issues; you must take them to court. I certainly will and join the class action suits for back up.
