WE have been harassed since we filed a chapter 13. We think everything is going Ok and then we get a threating letter to foreclose. WE have been paying our regular payment + and extra portion. They cashed them in January-February- and March. Then in April they took the normal payment and did not cash the extra amount at the end of the months. They cashed our house payment but not the extra payment. We have not had a invoice for four months afet sending in requests for our invoice. WE then received a basically form letter actually telling us nothing. They did not cash 2 extra payment and have sent back our May payment. To top it all they are trying to raise our payment $800 per month saying that interest rates have risen about 3%. We are now fighting agian with them.We are inour late 50's and this is taking a great deal out on our health and sanity.

My advice is to try and refinance, we was to the point that ocwen runt our credit and we couldn't find anyone to refinance or a company that ocwen wouldn't buy us back again, because they were not our original morgage company, we had our home 20 years, we refinaced with to do some repairs in 1999, and they took over in the first month, and then 6 months into the payments it was always something and we just couldn't deal with this company no longer, so we just walked away, it is now up for sale. we now live in Medina also. Can't cry no more, but I am collecting this letters and I'm going to send them to Washington, I would love to start a class action law suit against them in Ohio. Our struggle was over $300.00 that turned into thousands over a 5 years and 2 attorney, we didn't have the money to continue to fight, which I think they know that most of us don't. My children our grown and have little ones of there own, and our buying there homes, and now we are back to renting. It is so terrible and I just don't understand how they can be so unjustice to good people. I wish you the best, and hope that you can clear it up, if you are on a forbearance plan there is never a end insight. you are suppost to paying it off and they still just keep on adding. good luck. Everyone says to file a lawsuit, but there's like 28,000 against them now. My lawyer asked me what my goal was, and I said, get my account straight, and refi out from under them. I know I could file a suit, but what would I get, and how long would it take? Some will argue, "they need to be sued, they need to see they can't get away with it". I don't disagree with that statement, and I would love my lawyer to file, but I can refi quicker than I can settle a suit. So, I really don't know the answer to that question-for me, I just want out.

We have been fighting with them since they "acquired" our loan from Litton (who is owned by Ocwen now, isn't that convenient)? I just called to ask if they got the 2 payments I sent by Money-Gram on Friday and yesterday. She said yes. (They have us 3 payments behind, STILL, when we're not, cause they say they are owed money in the Chapter13, when they're not, and they put our mortgage payments towards some kind of plan). Anyway, when I asked her what that makes the next due date, ahe puts me on hold, comes back and says "Since there is a protection order on the account, I can not give you any details on the loan". I said "a what"? She says "protection order". I told her there was no such thing, she says that's what it shows. I said "They're wrong-isn't that a surprise"? She said I should call my lawyer, I told her to fax me a payment history. After I hung up, I called my lawyers office, she said she had no idea what they were talking about. I have been trying to refi out from under these idiots for a year, they have cost us 3 so far. If this pay history shows the next due as of 5/25, I know I can get away from them, and I will make sure I ask if they sell their loans to Ocwen, if they do, I'm gone to find another one. The sole job of Ocwen is to take your house-they can deny it, but that's exactly what it is!
