I called to make arrangements to settle my account with Palomar. The representative I spoke to (Nick) and I agreed to an amount, and when I had that amount available and called back to pay it, he increased the amount. This happened at least 2 more times. Nick was always incredibly condescending and patronizing.

When I called again, I asked to speak to another representative, simply because I didn't trust Nick & had such a bad experience with him. HE REFUSED. He would not let me speak to another representative and also refused to let me speak to a supervisor. He was rude and said he would NEVER let me speak with someone else; I either dealt with him or no one.

I tried calling back several times and even when I got another representative they would transfer me to him (I'm assuming he marked my account somehow.) It seems Nick has decided to make this a personal issue. It is terrible customer service and UNETHICAL collection practices because he LIED and changed the amounts several times and he was unbelievably RUDE. I am earnestly trying to settle my account fairly and he is making that impossible. It seems all he cares about is the commission (although he lied about that too and said he doesn't earn any.)

Dear Jenn,

 

You have a gold mine with these folks, including "Consumer" Ken's Saturday, August 23, 2014 rebbutal for using obsene language towards you and your complaint, harrassment, defaming your name in public, pain and suffering....I mean, for each one the many violations "Ken" used against you, you may have up to $1000.00 for each violations,plus attorney's fees!!!!.

 

Jenn, you can to file a complaint through the BBB and/or District Attorney against Duvera/Palomar Associates, let them deal with their response. Its easy and it doesnt take a lot of time. Allow the man running the show there, the one that's allowing this type of bahavior a fair chance to make the appropriate corrections within his company and or deal with the consecuence of having to renew his liability insurance next year.

You have the right to take these actions against a debt collector that violates the FDCPA:

  • File a complaint with the Consumer Financial Protection Bureau against the collector and or "Ken"
  • File a complaint with your state's attorney general.
  • File a complaint with the Better Business Bureau.
  • File a civil suit in your state or federal court for up to $1,000 including damages plus attorney's fees.

 

Remember, you have up to three years from August 23, 2014 to file a formal complaint against this company.

 

The laws under FDCPA are there so that, a company such as Duvera Financial,although managed to get away by using predaroty lending practices within California, do not engage in this type of criminal behavior.

How long was it from the time you and "Nick" agreed to an amount and you had that amount "available?"  Of course the amount is going to increase over ANY amount of time...NOT Nick's fault.

This procedure is NOT personal and is used to provide continuity and consistency in your account handling,,NOT Nick's personal issue.

How is it "terrible customer service AND unethical to try to collect monies owed them?  NOT Nick's fault here either.

How, exactly is he making it "impossible" to "settle your account" (in other words, pay your past due amounts)?  Again, can't fault Nick here.

What SPECIFIC evidence do you have to know he's lying about getting his commission?  It's highly unlikely that he does. Since it's doubtful he's lying, this one's not his fault either...that leaves only one person in the wrong here...YOU!

You're a serial deadbeat.

Oh, no I don't work for this company, just in case you want to use that as your argument against my rebuttal.
