Complaint Review: Phone Halo - Internet

Tell us has your experience with this business or person been good? What's this?

I was not happy with the four units I ordered and requested a refund. Phone Halo told me to return them, which I did. As of today, 7/8/2014, it's over a month later and nothing but "we're sorry that we're so busy" emails. No refund yet.

But now I've read Phone Halo's "Purchasing Terms and Conditions", which you can find here: http://phonehalo.com/purchasing-terms-and-conditions

Here are some relevant sections: (bolding added by me, for emphasis)

"... the Company does not promise that the products will be delivered to you on time or at all, or that they will function in accordance with their promotional descriptions....

...Regardless of whether the products are delivered or performed, you agree you will not seek a refund or other compensation..."

So if you purchase this product you are agreeing that they might not even send it to you, and if they do, it may not work. And you also agree not to seek any refund. So I guess I'll just let this be a lesson to me to always read the purchase agreement before ordering a new product.

I'm not a lawyer, but it sure seems to me like a good case for a class action suit.

Still no refund. But I have gotten a couple of emails saying that they are going to close my ticket and a few more telling me how busy they are.

Why would they promise a refund, tell me to send the units back, then not send the refund, but still say they're going to close the ticket? They may be a reputable business, but this is pretty much what a disreputable business would look like.

Before buying from these folks, please read their purchase agreement (link furnished in my first post) which says that even if they don't sent your units or they don't perform, you agree to not seek a refund.

I notice that a competitor, Tile, has a clearly worded, satisfaction guaranteed, refund policy, and does not require you to stipulate you won't seek a refund even if your units don't arrive or don't work.

Speculative?

In my complaint, above, I quoted directly from Phone Halo's Purchase Agreement, and furnished a link to that agreement.  Their purchase agreement actually says that even if the products don't arrive or function the buyer agrees to not seek a refund. I have still not received my requested refund, after more than a month.  Those are the facts. It is fair to say that from those facts I do speculate that the company is not going to honor my refund. I hope they prove me wrong. I just checked again with Amazon Payments, and still no refund. If and when I receive my promised refund I will post that event here.

This is entirely speculative. Phone Halo honors returns and exchanges for its products.
