First of all, I have a great credit score which I worked hard to gain and maintain! Then, several months ago, I start getting phone calls from a company called, Portfolio Recovery. Some have told me their names but the the most part, they do not tell me who they are. In one such phone call, they responded in the affirmative to my question: telling me the debt I owed them for collections was created in 1994!

One, I told these individuals that this debt was no longer legally sustainable: via the Statute Of Limitations (7 Years), which had transpired.

Two, I reviewed my credit report and all debts from that time-period have been removed from my credit portfolio!

Three, the standard attacks from Portfolio, have been to call every week; most of the time I do not answer since I have identification on my Vonage phone. I also have all the calls recorded, in the sense that they can be looked up on my Vonage customer site.

Four, they have called me at 8:45 pm, I have made them aware that these calls are not legal past eight pm. Then I am told they can call as late as nine pm!

I have not looked at the statute recently but if memory serves me: it was eight pm.

Five, I have told these individuals many times that they can not call my home and that they are from that time forward: to write me the details their collections and or authority. They again called this morning at eight am. Again, I saw who it was via the indent: and did not pick up. Nor did they leave a message all though they have in the past.

In most cases, collection agencies give up at some point and move on. I tell them about the statute and then they will go into how legally they 't touch me but ethically: I should submit payment!

My ex-husband created these debts when we were married on my cards or as a couple: I will not pay anymore for the past and the law is on my side. I noticed from the beginning that there was something different about these people.They have not used fowl language or threats yet but this debt is not legally sustainable in a court of law: just the fact that they will not stop the calls and they will not write me so I may respond with all the appropriate legal backup is upsetting! Towards a debt which died a long death many years ago!

Therefore, I intend to do a back-trace on the numbers they left behind and write them via certified mail. I will keep an eye on my credit and finish this. However, if there is anyone who can give me any information I can use against them in my letter: please feel free to do so. I am a Paralegal, and intend to use the law and slam it down their 'collective throats'!

This company has hounded me since 2002. I did have a very small credit card debt of $300 that I forgot to pay (yes some people are this dumb, and I was at the time). When the card charged off PRA got ahold of it and at the time I knew nothing about collection agencies... I agreed to pay them $50 and did so. A few days later they tried to take $1000 out of my bank account WITHOUT authorization!!!!!! They now claim I owe the $2000 on a $300 debt that is 7 years old. I refuse to talk to these people any longer. They have not responded to ANY written requests to prove the debt. They are rude, threatening and non-compliant. They need to be sued by everyone who is hounded by them!

Finally action taken TODAY. I too am a victim of this Collection Agency. After receiving MANY phone calls from them I requested to talk to a supervisor, which of course as many know is NOT a supervisor. Without giving her name on this post, I requested written documentation of the "so called" debt I owed. She insisted I give her my social security number which I refused to do. She also insisted I give her my new address. In turn I advised her that if she knew so much about me it was her obligation and MY LEGAL RIGHT for her to send me the account number of the alleged debt along with the original application I must have signed and all transactions on the debt. Within a week I received a form from her advising me to send her a POLICE REPORT of IDENTIFY THEFT to resolve this issue. THIS WAS NOT WHAT I ASKED FOR AND CERTAINLY NOT MY LEGAL RIGHT TO RECEIVE ALL INFOMATION I WAS ENTITLED TO. I checked my CREDIT REPORT, which I highly advise all to do, and found out this was a charge card that was CLOSED AND DISCHARGED BY MY BANKRUPTCY many years ago. I have LEGALLY filed a DISPUTE with PORTFOLIO RECOVERY ASSOCIATES, and as of today I have sent them a certified registered letter stating all facts. A copy of my letter has been retained for my records. Please, I urge EVERYONE to check their credit history immediatly and often. When something shows up on your report and it does not appear correct, file a dispute ASAP, and send a certififed registered letter to the company involved. Who knew this could happen to ordinary people like ourselves. I REPEAT, PLEASE BEWARE OF THIS COMPANY AND ANY OTHER COLLECTION AGENGIES AND KNOW YOUR LEGAL RIGHTS WITHIN THE STATE YOU LIVE.

Stacy in Dallas, I would like to correspond with you via email so I can find out who you sued and how you went about it. Elena, I would like to hear what has happened in your lawsuit as well. I am in the midst of a lawsuit where PRA III, LLC (Portfollio Recovery Associates) filed a lawsuit against me for a supposed debt that I don't even recognize and which does not even show up on my 3 credit agency reports. jpc1961

send them a cease communications letter via certified mail with return receipt requested These idiots are one of the worst bottom feeder collection agencies - I have dealt with them - They tried to collect a so called "debt" from me from the company I work for (My company pays 10% of all bills if were visit one of the company hospitals after insurance pays 90%) Sent them a certified letter - got back a "sorry you are zeroed out" letter and yes! If a debt is beyond the statute of limitations it is gone - off your credit These idiots buy these debts for pennies on the dollar and inflate the cost to their benefit I sued one of these idiot agencies and WON Don't get mad - get even

http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre18.shtm It's between 8 am and 9 pm. Also, they can hound you on a past SOL debt but you can make them stop by exercising your rights listed at the page above. Stop "telling" them what to do - like you said - make all correspondence in writing, certified mail.....you can tell them whatever you want but you won't be able to prove it in court.....
