on 8/22/14 at 8pm I went into an agreement with Precision Air & Heating for two new airconditioning units. For 14,206.00. Don Maddox was the salesman. He indicated that we would have to have airhandlers removed. These are located up in two different rooms covered with drywall. The drywall would be removed to take out the units and drywall repair would be around $500. They would also have to do some roof work do to new ducting which would be no greater than $1,000 total. which would be a total for everything 16,000. The installation of this project would begin Thursday Aug 28 2014. I made it clear to Don that I needed final prices before proceeding. He did confirm that the total costs of Demo and repair would be no more than $500 ea. In good faith I gave him half the money down which was $7514.27 in the form of a check. Don said he would have his guys (Demo team and meet with the roofer) come out on wednesday afternoon and would get back to me with final costs. I did not hear back from Don at all on Wednesday for the total fees. Thursday morining I had to call him and ask what the total fees were. The demo guys quote came in at $1,440. The roof repair came in at $1,400. So instead of the $1,000 additional fee he had assured us on came in at $2840. At that point I called Don and said I want to postpone the installment that was taking place on 8/28/14 until further notice. Don attempted to pressure me to continue with the install. I did send an email which I stated that I wanted to post pone the installation due to the extrodianry jump in costs. After that I was informed that I would be penalized $280 for not wanting to pay an increase of $2800. I was also informed that the cooling off period had passed.
instead of charging me the 280.00 Sandra Waddle quoted me it is now $2800  "either you pay 2800 more in fees or you have to pay it to them".
> After doing some research - The FTC states that sales made in the home the "Seller" Precision Air & Heating Should have provided me with the -Cooling-Off Period For Sales Made at Homes"

Sandra,

you are merely pond scum like the rest of the people and owners at Preciscion air and heating. You to lie like the rest of them talking out of both sides of your mouth. I find purely entertaining that you are responding to something that was posted moths ago.  I am confident that this report will be deleted. So pay ripoff report to remove the truth. Also, where is my FTC agreement. I signed off on? Yourself,Dan,Gina and Erik prey upon people to line your pockets. Smoke and mirrors. If you are a consumer. Look what they did with Yelp. They "Precision Air and Heating" pay to have the negative comments removed. Please don't make the same mistake I did by trusting that this was a good company... They will say one price and it goes from there more and more ad ons. I was a fool and put half down. intrusting that this is a quality company. save yourself from stress and getting taken advantage of. Find another company. These people are scam artist.

I hope you have a beautiful day Sandra.

I found a quality company with a great reputation. they didn't ask for a dime up front and the price on the contract is what I paid for all demo, repairs, units And install! Which was considerably lower than your contract for the units and install only.

Consumers consider yourself warned. Don't buy into their gimmicks.

Good afternoon Ms. Walter.  I have just finished reviewing your testimonial and welcome the chance to respond.

The homeowner called Precision Air & Heating, Inc. and asked for a quote.  Our worker went to the home, gave the quote and received a check for one-half the price ($7,514.27) for the contract.  The contract was approved and signed on August 22nd.  The homeowner set up an installation date and we proceeded with the contract.  On August 27, 2014 the homeowner e mailed a notice for a full refund of her deposit for cancellation of her unit  installation.  Subsequent e mails from the homeowner also cite various federal statutes related to cancellation and the e mail dated August 28 at 4:28pm clearly states a cancellation of contract.

The homeowner's complaint involves non-related, contractor (s) quote(s) for demo work and roof patching. This has no involvement with the proposal agreed upon and signed by you on 08/22/2014.  Precision Air & Heating, Inc. did not contract for this additional work; you did as the homeowner.

In addition, you indicated by your initials on our sale proposal that you understood there would be a 20% non-refundable amount for all scheduled work.  This amount is a representation of necessary customer materials ordered in relation to this specific contract and additional expenses incurred for the installation.  Our company never charges this fee unless costs are incurred.  With the cancellation just  1 day prior to installation, our costs were significant.  You sent an e-mail out on August 28, 2014 demanding a refund and informing Precision that you wished to cancel the agreement. A check was sent out to you on September 2, 2014 in the amount of $4,673.07. You acknowledged receipt of this refund in your September 8th e-mail.  Precision Air & Heating, Inc. has fully performed under the contract.

The complaint of our business being deceptive in our practice is completely off base.  Federal Statute 16 CFR 429.0 as well as Arizona's Home Solicitation Statue is not applicable.  Please understand that the federal regulations you have been citing regarding duties of door to door salesmen do not apply.  Precision Air & Heating, Inc is not a door to door seller and your contract with Precision is not governed by the federal regulations you reference.  Precision Air & Heating, Inc. did not extend credit to you, so federal rules related to consumer credit protection also do not apply.  In addition, the contract is not a Home Solicitation Sale that would be governed by Arizona State Law.  For this reason, your contract with Precision Air & Heating, Inc. is governed by Arizona contract law and Precison had no special duty to give you a 3 day right ot rescind or to notify you of any such right.

Owner Erik Bryan is aware of your review.  Precision Air & Heating, Inc. strives to keep Integrity, Quality and Trust at the forefront of every consumer interaction.  It is my understanding that various staff involved  kept communication lines open with you and responded in a timely manner to your various forms of communication.  We understand that you have a choice for your HVAC needs and understand you exercising that choice to find a company that best suits your needs.  That choice does not mean that Precision is at fault or failed to provide excellent customer service in any way.  We trust that you will find another company whose practices and values are in line with what you are looking for.

Thank you Tracy and enjoy your day.
