On 7/26/2011 I hired a local dentist "Procare Dental/ Joey Tirador" to Relign an existing upper denture and extraxt 9 teeth and do an immediate lower denture.
A treatment/Cost plan was written for $1625. The treatment began that day as 2 teeth were removed for which I paid cash. I was told the lower denture would have to be paid in full ($800) before any further work was done. On 9/06/11 it was paid.
On 9/19/11 the impression for the lower plate was done and my upper plate given for the relignment.
On 9/28/11 I went in for the tryin of the temp dentures. The upper plate felt as loose as it did when i left it and the lower plate was badly turned in so that it laid on the tongue. I told them this was unacceptable but they said wait till the lower teeth were pulled and see how it fit then. They said they would call when the denture was finished and set the date to remove the lower teeth and put the denture in.
After a year of fighting with the Dentists and staff over the faulty teeth and invalid charges etc. I filed in Small Claims Court against the dentist.
I went the extra step and attached all evidence backed by laws, codes, etc along with pictures of Dentures.
When i went to Court there was a Pro Tem Judge and seeing no harm I agreed to have it heard. During the hearing the Judge asked why i just didn't go have better dentures made somewhere else. I told her that one i had already paid this Dentists for them and two my family could not afford it again. She stated "So go get on welfare" I found this to be totally out of line. She did not look at the evidence or hear my side then said she would mail her decision.
When the decision came it ruled in the Dentists favor allowing him to keep my money and my teeth! I could not appeal because California Small Claims a Plaintiff xcan not appeal but a defendant can!
