WHY DID DESERT STATE MORTGAGE GET FIVE REPORTS FILED ABOUT THEM? EMPLOYEE COMMITTED FRAUD, EMPLOYEE WAS THEN FIRED, THEN EX-EMPLOYEE POSTED BOGUS REPORTS TO RETALIATE. INVESTIGATED BY STATE OF ARIZONA, STATE SAID DESERT STATE MORTGAGE WAS RIGHT TO FIRE EMPLOYEE..

An ex-Desert State Mortgage, LLC employee was fired from DSM for violating Arizona Law. Pursuant to their employment agreement, the employee was owed no money. Despite these facts, DSM gratuitously offered to compensate the employee some money notwithstanding no legal obligation to do so. DSM's generosity was met with spite, whining and harassment. The employee felt that DSM failed to provide their gift fast enough, so he instituted a campaign of harassment against Raul Harris, Desert State Mortgage's President.

The employee worked for Desert State Mortgage, LLC until early 2008, when he was terminated by DSM. He was fired because he violated A.R.S 6-909(H). That statute entitled Prohibited Acts makes it unlawful for a person employed by mortgage broker to concurrently work for another mortgage broker, without the prior written approval of all licensed mortgage brokers. Here, the employee worked for DSM at the same time he was originating mortgage loans for Liberty One Mortgage. Such conduct is a clear violation of Arizona law.

Furthermore, Arizona Department of Financial Institutions investigated this matter and found Desert State Mortgage, LLC acted appropriately in firing the employee. Please feel free to contact AZDFI (602)-255-4421 to verify their finding.

I believe an investigation of his activities will irrefutably prove his theft or diversion of my payroll money, which he acknowledges owing me, but refuses to pay me.

I believe he has converted MY payroll money for his own personal or business use.

BACKGROUND

I worked for Mr. Harris as a loan officer, for nine (9) months, and closed lots of loans.

One day, last spring, I got to the office, and everybody was visibly upset.

I was told by our processor, Kristina Cascia, (Redacted) that, prior to my arrival, two men had come into the office and requested to see Mr. Harris.

These men were livid, and demanded that Mr. Harris immediately return all files in connection with Intellichoice Mortgage.

Unbeknownst to any of us employees, Raul Harris, was explicitly told by law enforcement and Dieter Gable, the owner of Intellichoice that it was ILLEGAL for Mr. Harris to participate in any FHA loans, using Desert State Mortgage, because Desert State Mortgage was NOT licensed to perform these transactions.

Mr Raul Harris DID, in fact, do FHA loans.

Krisitna Cascia Kristina Cascia, (480 232 4857) was our processor, and can confirm and probably expand on Mr, Harris conduct.

You may reach, Mr. Dieter Gable, the owner of Intellichoice, at (((Redacted)))to substantiate the facts.

Because of all the turmoil and confusion, as well as, Mr. Harris unethical (maybe illegal) business practices, I became scared and uncomfortable, so I quit on May 20th, 2008.

I asked Mr. Harris for my paycheck, as ALL my loans had closed escrow, and he acknowledged having my money in his possession, and the associated accounting numbers in his possession.

It is customary for me to receive my paycheck along with the associated back-up information, corroborating the amounts.

Mr. Harris said it would take him 30 days to "pull it all together", and promised to pay me my money, and give me a full accounting of my commissions, along with a report, corroborating my commissions, and files for my records within 30 days.

What I did NOT know at the time was that Mr. Harris was obligated by state law ARS 23 -353, B,)to pay me my money on the next regular payday.

Therefore, he is was and is CLEARLY in violation of ARS 23 -353, B,, which states:

When an employee quits the service of an employer he shall be paid in the usual manner all wages due him no later than the regular payday for the pay period during which the termination occurred. If requested by the employee, such wages shall be paid by mail.

In addition, Mr Harris is in violation of ARS 6-906.

By law, he is required to maintain correct and complete records of transactions.

He refuses to provide me with anything. Despite many promises, he has failed and refused to pay me my paycheck or provide me with an accounting or report of my commissions, or provide me with loan document transactions for my records.

At the time, I didn't know my rights, so I took him at his word. My house was in foreclosure, and my cars had been repo, so I called him on June 17th, 2008, to confirm my money and documentation would be ready for pick-up.

He said he had the money, but that the next payday was on the 10th of July, 2008, and that he ran a business like a business, and that I had to wait until July 10th, 2008, and get paid on payday, just like everybody else.

So, On July 10th, I called him to see if my check was ready. He said no, he had changed his mind, and that the law gives him the right to withhold my money for 90 days, but that he would pay me on or before the 90 days.

I told him that was unacceptable, as my house was in foreclosure, and my family needed the money for food and survival.

Despite my pleading that I was broke and needed my money, he refused, telling me he was doing ME A FAVOR, because he said: ustavo. KNOW I the law. And the law gives me the right to NOT have to pay loan officers if I don't want to.

Mr.. Harris was attempting to bully and intimidate me.

I have this telephone conversation on tape, which I will give you a copy if you wish.

I have been reasonable and patient with Mr. Harris, in trying to get my paycheck, which he has owed me for months.

When I emailed or called Mr. Harris, I simply asked nicely for my money.

I don't want no trouble. I just want my paycheck.
