I was hired on 6/14/01 Filling out my own application and W2's to run team with my boyfriend. After several weeks of not recieving a paycheck, I spoke to payroll and was told that my boyfriend was being paid for everything and it was up to him to inturn pay me my wages. I later went into my own truck an started recieving pay checks.

The checks were few and far between, One such check was for gross pay of 3500.00 and the net pay was 363.00. After this I left the company, or was fired, in November 2001. This company reports to DAC. They show me working only 1 month. I was called a liar had the police called on me in Laredo,Tx. I was treated completely unfair and now suffer because of there actions as to finding other employment.

Susan, I have been in the trucking business since 1979. DAC came along and all of a sudden people who didn't have the guts to do dirty work were letting DAC do it for them. But fear not, I can get you back on track. Apply for a job, and if you are turned down politely ask for the reason in writing. Most people will do this much for you. If not get the reason and take notes; Name of person you spoke with; time and date; number you reached this person at including any extension number. DAC is a company that works a lot like a credit reporting agency. They are on-line with the trucking company. The trucking company enters the information and that's that. DAC has the same responsibility as credit companies have. If false or inaccurate information has been filed against you, you have the right to a rebuttal. Send what ever evidence you have.. but make sure what you send is a copy only. If you indeed received a statement from "Fly By Night Trucking" that you could not be considered for the job because of the statements R.E. Monson Trucking filed, you can start the process. HOWEVER if you have had 6 jobs and all 6 jobs have filed negative remarks, you will be at a loss to win this case. First: Get paperwork together. The letter from "Fly By Night Trucking", any logs, receipts, any proof you have that you were employed by them longer than the 1 month that they claim. Make copies and send them to: DAC Services 4500 S. 129th East Avenue Suite 200 Tulsa, OK 74134-5885 address it to Driver records. In your letter to them describe your dispute, enclose records, be sure to include your name, address, contact number, social security number and the name of the company in question. In your dispute be sure to tell them that you were hired as a team and later took a solo position. Did your boyfriend have the same problem as well? Send a separate dispute. Secondly: Send a copy of your letter to DAC as well as all evidence to R.E. Monson. Send it certified mail in both cases. In your letter to Monson be polite but very clear that you intend on correcting this situation if it means going to court. You may want to let them know that by making untrue remarks to prohibit you from other employment is illegal and you may consider exploring other avenues to find a quick resolve to this matter if they do not correct their obvious mistake. Remember be polite and to the point. Try these steps first they should either be the answer to your dilemma or the good start to the end. In your complaint you said that they called the police on you. For??? A 3500.00 gross and a 363.00 take home is not uncommon in this industry. Did you take advances? Did they charge you for them? Did you have lumpers, tolls, or any other deductions? Taxes will take about 1/4th of your check. Did they take you out of the truck when they called the police and then charge you to have it taken back home? Did they charge you for late paper work? There are a lot of charges that companies take out of drivers checks and the deductions are illegal. If they charge you for a tire, it is your tire, take it when you go. Please get back to me on this, maybe I can help you get some of your money back. They put you in that expensive truck, explain to you how much better off you are than the guy in the yellow truck. They pay you 23 cents a mile and then steal back all they can to make the truck payment. Good luck.
