I purcahsed my home in June 2010.  I was unable to pay the HOAs.  Since I did not receive any bills from the HOA, I was not sure if the payments were being incorporated in the mortgage.  Months went by and, again, I did not receive any letters.  

It was not until either April or May of 2011 that I receive a letter from Red Rock Financial stating that I owed $1,600. They even threatened to place a lein on my home and contact my association for signature to publish my property for sale in 30 days. All this without due process or a judgement against me.  I contacted them by telephone to find out more details about the bill.  They stated that the original bill was for less than $200, but most of the amount were penalties they added.  They claimed that they allegedly sent two letters via certified mail in late 2010 and early 2011.  The amount was for a lot less.  I explained to them that I did not receive them and asked if they could reduce the penalties.  They refused and the representative arrogantly replied that it was an issue with my mail carrier.  He never thought that it might have been an issue with his mail carrier as to why I have not received it.  Also, you will find that there is no record of my receiving the letters by certified mail. 

I did not appreciate being threatened in this manner and I felt that I was subjected to intimidation and heavy handed tactics.  My main issue is not receiving the letters in a timely manner.  Had I done so, I would have gladly worked out an arrangement to pay this bill before the penalties accumulated.

Our efforts ensure that the homeowners in good standing do not have to pay for the non-paying homeowners; therefore, the delinquent homeowner is responsible for our collection costs and fees. Our collection fees are accumulative as we progress through the foreclosure process required in each state. These fees are charged against the delinquent homeowners. The same fees apply regardless of the amount owed; therefor, the amount that is charge per specific collection step is the same regardless of the delinquent assessment amount we are trying to recover for the association.

Every homeowners association enacts their own collection policy that is followed by Red Rock and typically includes sending several reminder notices plus certified letters prior to a lien being filed. Red Rock is fully compliant with all laws and regulations that govern our collection process and fees. We are one of the lowest cost providers in our industry in all the states that we service.
