In you contract there should be a paragraph called Risks of Loss and Damage which in most cases states "you are liable for the loss and damgage to the property and such liability will NOT exceed the fair market value of the property at the time it is lost or damaged.". Which means if fact you are liable but you are only liable for the RV of the merchandise not the remainder of the contract and if you did agree to the optional liabilty damage waiver provission it does state that a police report should be filed and show that forceable entry was used to enter the home. If force is not shown on the report then again you liable but only for the RV(remaining value) of the property. If it does show forced entry to the home you are no longer liable. I agree with D's statements. RAC policy is that if the merchandise is in an unsecure location, then you are completely responsible for what happens to it. I once had a customer who tried to deny responsibility for his computer being stolen from his home. He tried to say that he didn't have to pay because it was stolen and that we covered that. When the police report was filed, we discovered that our customer's front door had neither a lock nor a doorknob...needless to say, the customer paid off the merchandise in the end.

I really do not recommend that 1st comment of stop paying. This could lead to criminal theft charges if you do stop paying. You may have waiver coverage with RAC, but the waiver clearly states that the police report MUST show on the report that there needs to be proof of break-in. For example; damage to your home where the burglers broke in. Also, not sure if this was your case, but if the account was past due, your rental agreement AND waiver is considered expired. The other part that is not helping you is that you had a new rental/lease agreement, six days later the merchandise is gone. RAC stores frown on this very hard. You may be telling the truth that someone else really has the TV, but as little time as you had the merchandise (6 days), and then also a delay on reporting this to the police, this made you look like that you did an attempt to steal merchandise. In addition, you state you thought that maybe someone in your home secured the TV, because you had problems locking the door. The door should have been fixed. If it was the case that someone that lived in your home moved the merchandise off your property, and this does not get reported to RAC PRIOR to doing this, this breaks your rental agreement with RAC. There should've been action taken immediately when you saw the TV gone. Unfortunately I do not have any suggestions on what to tell you except to do your best on locating the TV.

Jodi, Yes, renters insurance covers any item within your home even if it's not paid for. You are responsible, and they cover the cost to replace it to the company so you do not profit. As far as her sons, I read "secured the tv" to have a whole different meaning. I apologize for thinking she meant her sons stole it. Of course, I could've asked her why hshe didn't get the door fixed before buying such an expensive item, but I digress. (Cost of fixing door <$100...cost of replacing big screen tv....>$500)

Why would you say her 'sons' stole the T.V.? Her post says she thought her sons or roommate had SECURED the T.V. because her front door was broken. I hope you just misread the post, and are not actually accusing her sons to be mean.

Even though your TV was "stolen" by your sons, you are responsible for the balance. That is why you should have homeowners or renters insurance.

Just quit paying. You have the police report and a contract that has written in it you are covered for theft. Screw RAC. They are just trying to intimidate you. Next time they call tell them to get lost and if you are having the money automatically taken out of an accout, CLOSE that account immediately.
