Complaint Review: Ricardo "Ric" Madrigal Esq. Asst AG State Of Texas Atty General's Office - McAllen Texas

We need protection from this "protection" agent. His name is Ricardo "Ric" Madrigal. He is the Asst. Attorney General for the consumer protection division in McAllen, Texas and he is one shame-less liar who will pull a "Nifon" to get his case done.

His quest for revenge against me involved lying to a court of law, the 92nd Judicial District Court of Hidalgo County, the Hon. Horacio Pena, Judge. Everyone has heard of a few evil prosecutorial agents (DA's, prosecutors, police officers, politicians, etc.) who hide evidence to make a case against someone they dislike or just to "make" a case for statiscal measures (the case involving Nifon is one that made headlines). Well, this is one of those disgraces to the legal system. Persons like MADRIGAL hide their evil behind the cloak of justice and a big title.I hope you're proud of yourself MADRIGAL, you evasive, slime-slick, diaherria mouthed (man).

In Nov 2003 Madrigal called me in to his office under an Examination Under Oath on a case he was trying to make against a farm labor contractor whom I happened to be assisting with a Dept of Labor application process. During his examination of my activites involving what is called "legal document preparation" I did fully inform him of all that I did and just how I operated. He knew at that point in time- November 2003- what I was doing involving legal documents and the manner in which I did the work. As the examination went on, I saw how he was trying to manipulate and shape things to fit the type of case he wanted to make. The end result was that I called him on his bullshit and low-down scheme, and told him in expletives what I thought of him.

On May 9, 2006, out of nowhere, a restraining order is served on me, and before I knew what was going on the injunction and pictures of my little office were on the air and print media!!! This is over 2 years of doing the same business at the same place with the same phone number he had in his files. My life was turned upside-down by this jerk.

During the period between the examination in Nov 2003 and May 2006, not one word, not one letter, not one notice was sent to me that there was a problem with my service and business. I was alleged to be a deceptive trade practices case!! And because I was a notary public, same as I was in 2003, I was also alleged to have violated the Texas Notary Public Law. Why didn't this (man) ever call me back in during the over two-year period to tell me it was wrong? Why didn't he file against me during the two-year period he did nothing? He knew where I was; I never moved or changed my number or address. Now what he did to pull his way around the statute of limitations (two years from the date he knew or should have known: November 2003): he first tells the Court that he never investigated me, but then, as a witness on the stand for the State and under oath, told the court that "when we investigated (him) in 2003...."! HE KNEW ABOUT MY ACTIVITIES IN NOV 2003.

When the State comes after you, you need MONEY. Hell, Madrigal had an assistant attorney general (assistant assistant A.G.? who pulled an objection then didn't know what he'd objected to!), some lady, Eliza Luna, whom I never figured out what she did, another lady carrying files, an "investigator" (really a poloraid "photographer" and lousy actor),two other guys to set up his equipment; d**n, what a show! And I sat there with my attorney, both having to carry our own files. The little guy against the State.

And the judge and my attorney missed the point where he lies!!!!! I tried to get my atty to make something of that. I was compelled to plead guilty (the cost to adequately defend was not within my reach). I did file a grievance against Madrigal with the State Bar Grievance Committee and I guess lying to a court is ok to do when you're a prosecutor (but if I had lied, oh boy).The case was appealed and is now pending.

I need help against Madrigal's malicious prosecution. It was wrong. He could have just called me in and told me that he felt it was in violation and asked me to stop. NO. He needed a "case" to justify his office. If anyone reading this knows Attorney Pete Kenedy of Austin, Texas, please refer this one to him. Mr. Kennedy was the attorney who represented Nolo Press against the State of Texas as Texas tried to keep Nolo Press's how-to legal books out of the hands of people in Texas; AND WON! Hey, Mr. Kenedy, I have court transcripts of the proceedings and the tape recording for the 2003 examination. H-E-L-P.
