I am a legal transcriber living in New York City. On 6/29/02 I contracted via phone and email to do a trial transcribing job, involving the National Labor Relations Board of Houston, TX, for R&S Typing Service.

I was loaned a 4-track transcribing machine, which I would be using for the first time, and given a 245 page NLRB hearing case with transcribing rules particular to Ms. Orms that did not conform to any I had encountered in my ten plus years of transcribing for various companies.

The job deadline was specified as 7/4/02. I did the best I could with a strange machine, doing an unusually large "trial" job and working under the conditions of unfamiliar rules.

I completed the job and submitted it by email on 7/3/02. On 7/9/02 I was informed by email that my work was unsatisfactory and asked to return the 4-track machine immediately to her friend in upstate New York. I complied immediately with this request. In the same email I was told that if I would send in my invoice (at $1.00 per page for the trial against $1.25 per page for future work) I would be sent a check for $245.00 immediately.

When no check was forthcoming I inquirecd by email on 7/12/02 as to what the problem was. I was told by Ms. Orms that she was working on another case and could not write a check until she finished and had an additional day's rest. It became apparent that Ms. Orms had no intention of paying me any time in the immediate future, if at all, and that she was punishing me because she was dissatisfied with my work.

I have attempted to contact the Texas Workforce Commission for intervention in this impasse. Apparently if Ms. Orms, properietor of R&S Typing Service, is not satisfied with the trial job she will delay payment for up to a month, despite promising immediate payment in order to retrieve her 4-track machine.

didn't even know this website was available, and didn't know he had commented on same. Yes, I did contact him. He told me was very competent in transcribing, which was not the case. His work was extremely poor with very good tapes, which had to be completely trashed and retyped, making me, as the owner, paying double to get work transcribed. Yes, I did say that I would pay him as soon as I received my equipment back, which cost me over $1,100, plus shipping, but he did receive payment, after the job was complete by another typist. However, what he doesn't state that is, because of his extremely bad work, and having another typist type it, the case was late, I incurred penalties and a report on my permanent record that the case was late. I did not deduct this amount from his bill.
