i contacted the states attorneys office as well as the bbb in this matter. i tried to get matter rectified by sending letter to company with all info included here and they responded by appling a lein against the property that i have on the market for sale.

on feb 17, 2006 russell was hired to fix heater. i was told they would have it done that day and with urgency due to below 0 temps expected for the weekend. that is why i chose not to have other company do it because they told me they would not be able to get to it till the 20th.

on feb 20, 2006 i called russell to get result of bill and work performed and when the invoice could not be found after being told repair was done was passed to vaughn from the lady that answered and was then informed it had infact not been done. i was not called about this on the 17th or any time over the weekend, so i was not given an opportunity to get heaters in avoiding the house freezing up. it took me calling them after 12pm on 2/20/06 to find out what was going on, keep in mind the house is heated with water and registers. i voiced my dissatisfaction of not being notified including after being told that everyhting was fine at the house and i told vaughn i hope not or it might have to legal.

well in fact there was pipes burst, register cracked , and water heater ruined due to the freeze up. the pipe burst meant having a hole cut out of the ceiling which was not patched, the register caused damage to flooring and ceiling below and the water heater having to be replaced caused me to put up money to get a new one (since i wouldnt go with the estimated charge of 750.00 to have one installed by them from them. via a call from the realtor stating that russell told realtor to call me since russell didnt want to call and talk to me about this) as well as rust going into water system from the exchange of old and new water heater causing damage to faucets in the house. they told me that tech went through and fixed all the faucets for leaks due to the rust, but when i was there in march i found 3 faucets still leaking.(they charged for this to already be done on the first bill)

with the pipe burst tech ripped fabric that was liquid nailed and velcro to wall, covering opening under stairs to clean up water and then left in tub 2/24/06 which i found molded a month later when out there 3/27/06. luckily i had a spare register in the garage that they used to replace cracked one but they charged for end caps to stop the flow of water for the register but took them with them a few days later when they put other register in place. they also did not put a shut off valve at that register stating because he said it is a hard to find part and i was selling so let the new owners worry about it.(i wonder if there is a code issue like for a water heater shut off)

they charged to bleed off air in system of hot water pipes for the heat of the house, but when i was there in mar i found that the biggest section in the upper living room was not producing heat. (i was already charged for this to be done on the first bill)the old water heater was sitting in the yard for over a month and would still be today had i not gone out there. they had left their garbage from mcdonalds in a box with parts for the garage door opener located in the kitchen as well as on the sink in the laundry area, which i offered to clean up for them when i was there disputing the bill on 3/27/06 i had already received stating all work was complete.

they agreed to go back out and fix leaks that they said had already been done, and to bleed off air they said had been done (so the big part in the living room heated) and to remove water heater from yard and to put screens back in that were laying at each sink and to install overflow pipe on water heater. they did some of this and then sent me another bill for 125.87. charging for repair and parts to one of the sinks that now operates incorrectly as well as everthing else that they were supposed to have done in the first place. to this day there are screens not in that were supposed to be put back in on 3/28/06. i had to turn water back on at the shut off at the lower bath sink.

they charged for 2 tech to look for leaks for 2 hrs on 2-20-06 when they agreed, after i asked, to go put heaters in the house to thaw it after the very low temps over the weekend and my conversation with my realtor telling me that when they did her heater they left heaters for her. i asked how can they charge that, i was told on 3/27/06 while in the companys office with vaughn that if his techs say it took that long then it took that long, thus he refused to back off even 1 of those 2 hrs charged. the leaks did not appear till after the house had thawed for over 3 days when they couldnt even complete the heater situation because of the freeze and then because the register cracked out so they had to shut off the water. and the next day when the pipe burst in the ceiling they had to shut off water as well as the water heater situation.

on the original bill there was a charge of 268.20 that was unexplainable, that they did take off + tax, but had i not gone over it with him it would never have been known. i wonder if there is criminal implications in this. i wonder how can i be charged for work done due to their negligence of not calling and being told on the mon the house was fine after it was supposed to be done the friday before. and when i mentioned legal action due to unknown problems on original conversation 2/20/06, when i asked if they would get a new water heater at hardware store that i already paid for, he intially refused to do so (which was fine because i had already looked into options to have someone else do it at a cost of 450.00 installed)and he told me he dont sell junk and i had told him that i was selling the house i didnt need a water heater that would last 25 years i just needed one that would last the average of 15 year. after again explaining my issue with not being called right away then he agreed to get the water heater i paid for 350+tax and install it.

they should have to reimberse me for the water heater and for loss of propane for the dates of 2/17/06 to the date of leak found and fixed with copper tubing. they should not charge me for parts and time spent rectifying their lack of doing the job in the first place and not calling me to let me have an opportunity to keep the house from freezing and causing more damage which created the additional charges. they should compensate me for having the hole patched where they cut out for the pipe leak. they should compensate for having someone go out and fix their error on the sink upstairs and completing the screens being put in. they should compensate me for the fabric that i had to get cleaned and reinstalled. they should be black listed due to the knowledge i have after the fact that they have done unscrupulous things to otheres who didnt file complaint and just paid them and then paid others to do their work corrrectly.they should write a letter of apolgy detailing all their misrepresentation of service. most importantly, they should immediately remove the lein applied to the house preventing me from selling it and they know it.
