Having read through many of the complaints on this site I have noticed that many of them involve Safeway's insured "unlicensed or suspended license" drivers and believe that there is a pattern here. My son was involved in an accident involving a Safeway insured driver. (see report of 5-17-05) The person who hit him did not have a valid U.S. drivers license and it appears he had never had one!! I understand that Safeway is a non-standard insurance company but how is it that they can issue a policy and collect fees from someone that never had a valid license to begin with? How can ANY insurance company issue a policy to someone that does not have a valid U.S. drivers license? From what I have read here, it appears that they are targeting minorities and specifically illegal aliens, collecting their outrageous fees and then refusing to pay out on claims when their drivers are at fault by claiming that they were driving without a valid license. This is just a money machine for Safeway--collect fees and never pay on claims. This company should not be allowed to continue to operate in Georgia or anywhere else. I have written a letter of complaint to the Georgia State Insurance Commissioner and to the State Attorney Generals office and strongly suggest you do the same. While your situation is somewhat different than mine, unlicensed vs. suspended license, it would be interesting to know exactly when their license was suspended? If you can find out this information it may be helpful for your claim. Was their license suspended prior to Safeway issuing the policy? If so then it should have been the responsibility of Safeway to find out if their license was valid before issuing the policy. If they failed to verify the statue of the license when the information of it's suspension was available to them then it seems they should be held liable. The real question you need answered is was his license suspended while he was insured with Safeway or was it suspened prior to Safeway issuing the policy??

As a employee of a major non standard auto insurance carrier I think MORE consumer education is necessary to help people understand how insurance works. As unfortunate as the situation sound NO insurance co will cover a claim caused by an unlicensed driver, it isn't legal for them to even BE on the road behind the wheel. NO company will cover a loss under these circumstances. Companies work very hard to make sure they are insuring ONLY validly licensed drivers, they order Motor vehicle reports when a policy is written BUT licenses are suspended every day due to violations. Dept. of Motor Vehicles in states are NOT required to report this fact to the Insurance carrier. It is the responsibty of the DRIVER to stop driving, PERIOD. I'm afraid the only solution is to try and recover losses in a civil court.
