SUMMARY OF ARBITRATOR’S DECISION

SCVMS, L.L.C., Complainant

v.

Anonymous, Author of Report #1035480,

Complainant SCVMS, LLC (the “Complainant”) has challenged the truthfulness of certain specific statements (each, a “Statement”) posted by Author “Finish Line” or Anonymous (the “Author”) on the Ripoff Report website at www.ripoffreport.com as Ripoff Report #1035480 (the “Report”). The Author did not submit a response to the Complainant or any contact information. Therefore, in accordance with the Ripoff Report VIP Arbitration Rules (the “Rules), the Author waived their right to participate in this Arbitration. By submitting a Report and a Complaint on the Ripoff Report websites, both the Complainant and the Author have agreed to submit the dispute to the Ripoff Report VIP Arbitration Program.

In accordance with the Rules, the Arbitrator was asked to decide whether the challenged Statements were an opinion or a fact. If, and only if, the Statement was determined to be a statement of fact, the Arbitrator was asked to further decided if, by a preponderance of the evidence, to determine if the Statement was true or false. If the statement identified by the Complainant is determined to be an opinion, no determination will be made as to that particular Statement because an opinion cannot be determined to be true nor false.

In this case, the Arbitrator had only the evidence submitted by the Complainant to consider. The evidence submitted included Ripoff Report #1035480, Complainant’s Arbitration Statement, Complainant’s Witness Statements, and supporting documentation.

Each Statement challenged by the Complainant has been considered, together with any Witness Statements and Documents provided by the Complainant for determination of the truth or falsity of the Statement. The Author did not provide a response to the Complaint.

The Arbitrator determined that the certain statements challenged in the Report were false. Therefore, according to the VIP Arbitration Rules, those statements have been redacted.

Initially the arrangement was to pay weekly for my services. The contract that was signed by both parties agreed to payment for services rendered but made no stipulation about payment being based on SCVMS being payed by their clients or not.

 

As time went on and my company grew, we were able to extend our payment schedule out to be paid when SCVMS received payment from their clients. This also included investing in the Eastpoint Systems computer networking program to connect our office with the SCVMS office in Porterville CA. The computer program allowed us to file our property reports, attach photos and complete billing invoices. 

 

Our company was processing a high amount of volume of property work orders. There were occasionally work orders that were not paid because of justified reasons. These work orders were written off. As the payment schedule extended out, our receivables averaged over $100k. This was not a big issue because the payments stayed pretty consistent.

 

Debbie, Claudia and another clerk Vicki, vendor accounting clerks for SCVMS worked with us to maintain a current report of all receivables communicated with us what invoices were flagged for payment and any invoices that needed to be written off. There was a pile of invoices that was growing and aging but we were assured that they would be paid eventually. ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). Somehow these receivables went from being flagged for payment to written off with no proof or explanation.

((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). SCVMS continued to send us a high volume of work orders and demanding completion by the deadlines. Work volume never changed, our reporting was timely and accurate and payments declined dramatically.

 

In May of 2008, I was forced to relocate to Nebraska. I tried to keep my business going in Colorado with the remaining 2 people by pawning vehicles for money, selling other misc. items and paying what I could from my new job. We were simply trying to survive hoping that the rest of the receivables on the books would start to be paid and the business would survive. The payments that were coming in did not cover the expenses of operation and finally we were forced to abruptly cease doing business. By July 2008, I lost my house to foreclosure, declared personal bankruptcy and was divorced. ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). I maintained possession of 2 utility trailers that were originally supplied by SCVMS for me to get started. I was contacted by Casey Castillo in regards to the equipment that was originally supplied by SCVMS. He proposed a settlement to clear the account. ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)).

 

I spoke with several lawyers on the matter and even had one send a letter advising SCVMS to ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)) or legal action was going to proceed. I was financially wrecked and was unable to retain a lawyer based on contingency. Several lawyers advised me that I had a strong case but had to be ready to pay up to $35-45k for representation to win the judgement. I was obviously unable to proceed so the matter was dropped and I'm sure by now the statute of limitations has expired on any of the money that I was owed.

None of the stories are ever told because the majority of ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)) contractors are of spanish speaking minority and technically not legal citizens and they just move on to something else rather than risk getting caught themselves. ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)) starves out contractors and simply brings in new people to replace them. I wish that all of the contractors that have been defrauded by ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)) would have a chance for compensation instead of ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)) endlessly being able to take advantage. I was gullible and payed a huge financial price. When I read the other report on this web site, I felt impelled to tell my story. I hope others will step up and at least give support to the fact that the 2 reports on this site are not isolated incidents.

First and foremost, I must admit that this goes against every fiber of my being.  Erich I do not agree with publishing matters that could and should be held confidential.  With this being said I must respond to clarify a few things and set this allegation straight.

Statements made here are clearly the allegation of a disgruntled vendor who lost control of not only his business but his personal life.  The ironic part to this relationship is that a friendship existed in the place that now is occupied by bitter distain.

Now to clarify the allegations:

1-      Yes, SCVMS did help you by delivering the goods / materials necessary for you to begin your operations.  This was an investment that was done in terms of good faith.  I think the mere fact that SCVMS was willing to take on this financial obligation speaks volume to the owners character.   Both parties agreed to a very conservative amount of reimbursement.  The vendor (Finishline) asked SCVMS to take this reimbursement out of their payment.

2-      SCVMS was served with other financial obligations that Finishline was evading.  In the end SCVMS had an obligation to forward this money in behalf of vendor.

3-      In regards to sending high volumes of work orders with demanding completions and deadlines.  That is the nature of the business; this industry revolves around demanding deadlines.  Payment is also commensurate on completing the work by the deadline/due date.  We understand that not all businesses are able to abide by these rules and thus this industry is not for all types of individuals/businesses.  However, each vendor sets his own territory/coverage area and volumes.  If this is done correctly by the vendor then completions is not a problem.  Unfortunately there are a handful of vendors who bite off more than they can chew.  I cannot speak as to why Finishline spiraled downward but it is apparent by comments mentioned here that it was not just business that went downhill.

4-      The concluding statement about not legal citizens is simply unfounded and untruthful.  SCVMS has a documented vendor boarding processes that all vendors must complete and comply with.  Screening and background checks are part of this process.

5-      On a personal note, I know firsthand what kind of person he is and upstanding Christian would definitely be TOP on my list.
