My husband had taken out a title loan agianst our pick up. I am the primary person on the title and i never signed for this nor did i even know that he received the title loan until i was sitting on my couch one day and heard a car door, stood up to see who was there and the repo man was hooking up to my truck to take it away. The moral of this story is FIrst and foremost how was he able to get a title loan on a vechile with two names on the title without that being signed in front of a notary. If this is the case then anyone could take anyones title and do this. Second the man who repoed the truck was very rude saying uncalled for names to me and took off with my truvk drove through my ditch and tipped my truck up on its side. I went to get the property out of my truck about a week later and was told i  needed to pay 60 dollars for a lock smith i refused if they would have picked up the phone to call me i would have gave them the keys. The next day they dropped my property off on my front porch. The day this all took place i contacted the lending company asking for a copy of the loan agreement in returns they never ever sent it to me as i asked.Whenever i have called to speak about this to anyone they tell me they cant talk to me about this becaues im not on the loan. They have taken our truck have not heard from anyone or heard anything so im sure my truck is gone, I dont see how they can do this and now i have no car and two kids to get around. Upset.

I did not once say it was not his fault i was stating that i dont feel that the title loan place should have given someone the loan without both signatures. Reguardless i am the one without a vechile now. I dont care whos fault it is i am just stating that i feel as though i got the short end of the stick of the whole deal. So i dont know what your comment was i guess i dont see what the point was.

You no longer own the truck. This is the fault of the lender and the repo man but none of the blame should be directed toward your husband. OK, we get it.

 There is one very key bit of information you need to know.  How are the Title Holders(you and your husband) listed?

If it is You OR Your Husband, then your Husband has the legal right to sign over the title without your permission or signature.  However, if it is You AND Your Husband then to be legal it needs to be both signatures.  However, contrary to what you think the signature does not need to be notarized.  So there are a few possibilites

One.  Your (Soon to be Ex???) Husband got the title loan without your consent because the title was listed as "OR" and since he failed to pay on the loan the car got reposessed.  Unfortunatly in this case the only one you can go after is your Husband and only through Civil Proceedings, that is nothing illegal was done by him or the Loan Company.

Two. Your (Soon to be Ex???) Husband forged your signature on the Title.  Therefore he comitted a crime and if you wanted to go after him for Forgery you probably could.  Because you are married it may or may not enable you to get your car back.

Three.  Your (Soon to be Ex???) Husband turned over the title, only signed his name on a title where you were listed as AND and the lender still loaned him the money.  In this case there is a possibility that the transaction is invalid and you may have good grounds to get your car back.

Four. Something else.

And because of reason four is exactly why you need to consult a Laywer ASAP.  As they can tell you the specifics of your case and who(if anyone) you could have recourse against.
