My mother was a Spiegel's cardholder when they went bankrupt. All of a sudden she was receiving numerous phone calls and statements from Cardholder Member Services. Everytime she made a payment, they would post the payment several weeks later and then charge her late fees. When she died, I mailed them a death certificate.

At the end of the month, I got the B.S. condolence letter and the company asking for a death certificate. Duh? Why ask for a death certificate when one was sent and they acknowledged her death. Later I found out that this company was not licensed in the state of Colorado to collect on any debt. About six months later, Cardholder Member Services aka Card Works turned the account over to an attorney. I wrote the attorney a very nasty letter and I told him to cease and desist or risk losing his law license. I never heard from again.

Last week, I received a letter from Enhanced Recovery SErvices. The letter was addressed to my mother. Apparently these sleezeballs either did not inform Enhanced Recovery Services that my mother passed away or these idiots think that either she was going to pay or I was. I have filed a complaint against both agencies with the Florida, NY and Colorado AG's office. I will keep you posted. I have informed the legal department and the HR dept of Cardholder Member SErvices to cease and desist or else.

Spiegels response from the NY attorney general's office

I just received a response from the NY attorney general's office. I was told that they would close the file on my mother. I was also told that it was not up to them to verify my mother's death, it was up to me. The agency also complained that I was charging them for them to obtain a copy of the death certificate. I wrote a response and reminded Spiegel's that my mother's death certificate was folded on top of the letter announcing her death. It was not up to me to constantly provide proof of her passing to harass the boys in the mailroom and get up off their rearends and look for the death certificate.

My attorney called ERS and was told that they did not know about my mother's death until they were contacted by the FL AG's office and that the file/case was closed.
