During the Xmas season I was shopping at the Grove in Los Angeles. I normally do not use public restrooms, for reasons that will be clear later, but I needed to use the one there badly, so I went in.

Needless to say, the late christmas shopping rush made the facilities crowded. As a handicapped individual, with a placard for my car and a bad knee, I went to the handicapped stall, and informed the individual inside who I was and my handicaped status, and asked him politely to hurry. His answer is unspeakable on this family site. In the course of arguing I nearly had an accident, luckily the stall next became available. I did my business with great difficulty, though I felt embarassed and disenfranchised.

My wife and I noticed the rude individual in the parking area and we were able to get his license plate no. I called the CA department of civil rights and told Linda Cooksey my story. She didn't seem to care about me or my plight, and seemed ignorant as to my rights as a handicap!

She'll be hearing from my lawyer.

Stella, While I feel badly for how you were treated, I think your blame is lying in the wrong direction. The state department isnt responsible for how individuals act toward you as long as no laws were broken. Getting their license plate # and calling willnot get you anywhere, since the state office will only check to make sure that handicapped facilities are available at the location. The location itself is responsible for making sure that the facilites provided for the handicapped are used properly by the proper people. This has nothing to do with civil rights or your rights as a handicapped person. Your rights, by the way, are the same as everyone else's ion this country, you just get to park closer to the front doors and use larger restroom stalls. These are provided to you to give you the same amenities as everyone else without increased difficulties. Also, being rude is not against the law. If you had a problem with the individual, you should have said something to him when you had the chance. You have the same right to be rude to him as he does to be rude to you. If you are too chicken to do that, you should have gone to the customer service area of the location and filed a complaint there. At the very least, they would have compensated you somehow for your embarrassment. No lawyer in their right mind is going to take this frivolous case of yours and you wont be compensated one penny by the state, nor should you. Chalk it up to a lesson learned and next time, complain to the correct parties, not the ones you think will be easiest to take to court.
