Steve, you said we don't have federal highways any more. Why, then, do we still have highways that say U.S. and a number. Like interstates they were built with federal money, but patrolled by state and local police. The federal goverment never had patrolling lawmen. Prove me wrong. And please don't insult me with the crying typing.
I was caught, maybe not fair and square, but I paid my fine and went on about my business (one good thing about SC, paying the cop who stopped you).

I can't attest to what you wrote. I got my pcture taken, actually the front tag back in the '70s. I was on I85 and passed under a railroad overpass and saw a VW van sitting on the side of the road with the rear hood open like it was having engine problems. When I got nearer a red light flashed and I knew I was shafted. When I was pulled over a mile or more down the highway by the Highway patrol, I told the cop I thought it was an old hippie bus with problems. His answer was;" So did alot of other people today." I was doing 84 in a 70.
I also said the state may be giving city cops permission to patrol out of their area, I should have said 3 mikes outside their city limits. One town has been stopping people on I85 for years. Another town's chief gave his rent-a-cops permission to do that for months!

Jeff.....that's not actually the way it works.You may have beaten a ticket, but not for the reasons stated. Here's the way the law works.You are legally responsible for the operation of any vehicle registered to you.Liable for accidents. Liable for injuries. Liable for tickets, both parking and moving violations.
You are correct that the burden of proof is on the ticketing agency.BUT, not to prove you were driving the car.They only have to prove your vehicle was in violation of the law, ie: speeding.
If you go to court and try to say you were not driving the vehicle, the court WILL compel you to identify the person that was driving your vehicle. Then they will ask you if you willingly let that person drive it, or if it was stolen.Your "pleading the 5th" ploy will not work.
The only way these tickets get beaten, is that under the law, you have the right to "confront your accuser". That is the ploy lawyers use to beat these type of tickets. Then they go further. If the agency that runs the cameras does actually send someone to testify, then you go to Plan B. You challenge the calibration of the speed measuring device, and also the accuracy of its aim, in that it could have actually hit a passing car.
And, we don't have "federal highways" in the United States.We have "Interstate Highways".The federal government subsidizes these "Interstates", but the roadways themselves are owned by each state. State law applies to the enforcement of the law on it's interstates. Thats why different states can have different speed limits on the same interstate highway. State Troopers / Highway Patrol usually have jurisdiction on Interstate Highways.
If these Interstate Highways were "federal" as you claim, they would need federal law enforcement patrolling them.
Don't be so stupid all of your life.Man up. Pay the ticket, or go to traffic school and learn how to drive safely. After all, you WERE speeding, right?
You are just mad because you got caught!!

I don't know about your state or not, but I've gotten out of red light tickets (that weren't mine) Remember that is on the burden of the City/County/State to prove your guilt, you do not have to prove your innocence. The camera's only take a picture of your license plate, not you. When you go in front of the judge, ask what proof they have other than a picture of your license plate, do they have a picture that can positively ID you as the driver. And if you're asked if it was you or not, plead the 5th, don't lie because you'll get in deep sh*. With no proof of you driving, they have to dismiss the case...

Sorry you got the ticket in my home state, but you more or less admitted you were speeding. I can actually feel your pain as I got my car's picture taken back in the '70s on I85 in the upstate. Just because it's a federally owned interstate highway doesn't mean you can't be ticketed by a city cop. That's been argued before to no avail. Now SC is pondering allowing city/town cops legally to cruise outside their legal limits. That way the city/town cops have a chance to make their salary for the week. By the way, when we go to the coast, we prefer Hiltonhead or the Beaufort area, we stay off I95.
